SEC"LION I. This bill seeks to more accurately reflect the costs incurred by the
Solid Waste Division in providing necessary services to lawfully dispose of refuse. l~hc
Integrated Solid Waste Management Plan complies with stale mandates of waste
reduction. Implementation of the plan will require capital improvements. new equipment.
and maintenance of existing equipment. "I~he present subsidy from the General Fund is
substantial and this will reduce Solid Waste dependence on the General Fund.
SEC"LION 2. Chapter ~0. article 4, section ZO-49, of the Hawaii County Code
1983 (1995 edition) is amended to read as toflows:
Section 20-49. Fee schedule.
(a) Charge rates shall be established as follows:
(1) Landtill Disposal.
(A) Rate by weight [$35 ~ Dollars per ton prorated accordingly.

SECTION 4. If any provision of this ordinance, or the application thereof to any
person or circuanstance, is held invalid, such invalidity shall not affect other provisions or
applications of the ordinance which can be given effect without the invalid provision or
application, and to this cnd, the provisions of this ordinance are declared to be severable.
SECTION 5. This ordinance shall take effect [upon] 30 days after approval.
