ORDINANCE NO.
AN ORDINANCE AMENDING CHAPTER 20, OF THE HAWAFI COUNTY CODE
1983 (1995 EDITION), RELATING TO REFUSE FEE SCHEDULE.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAI']:
SECTION 1. This bill seeks to more accurately reflect the costs incurred by the
Solid Waste Division in providing necessary services to lawfully dispose of refuse. The
Integrated Solid Waste Management Plan complies with state mandates of waste
reduction. Implementation of the plan will require capital improvements, new equipment,
and maintenance of existing equipment. The present subsidy from the Genera] Fund is
substantial and this will reduce Solid Waste dependence on the General Fund.
SECTION 2. Chapter 20, article 4, section 20-49, of the Hawaii County Code
1983 (1995 edition) is amended to read as follows:
Section 20-49. Fee schedule.
(a) Charge rates shall be established as follows:
(1) Landfill Disposal.
(A)Rate by weight: [$35] Dollars per ton prorated accordingly.
Year beginning on July 1 of each calendar year.

SECTION 3. Material to be repealed is bracketed. New material is underscored.
In printing this ordinance, the brackets, bracketed material and underscoring need not be
included.
SECTION 4. If any provision of this ordinance, or the application thereof to any
person or circumstance, is held invalid, such invalidity shall not affect other provisions or
applications of the ordinance which can be given effect without the invalid provision or
application, and to this end, the provisions ofthis ordinance are declared to be severable.
SECTION 5. This ordinance shall take effect July L, 2003.
