HomeMy WebLinkAboutRES 014 Draft 01 2002-2004 COUNTY OF HAWAII STATE OF HAWAII RESOLUTION NO. 14 03 RESOLUTION AUTHORIZING THE OFFICE OF THE MAYOR TO ENTER INTO AN AGREEMENT WITH THE HAWAII STATE EMERGENCY RESPONSE COMMISSION AND STATE CIVIL DEFENSE TO ESTABLISH THE FRAMEWORK FOR FUNDING OF THE PROJECT TO UPDATE THE EMERGENCY RESPONSE PLAN OF THE HAWAII COUNTY LOCAL EMERGENCY PLANNING COMMITTEE WHEREAS, pursuant to Hawaii Revised Statutes 128E-5, the County of Hawaii has established a Local Emergency Planning Committee (LEPC) to work with the Hawaii State Emergency Response Commission (HSERC) to plan and set policy regarding potential problems involved with hazardous materials; and WHEREAS, the funding for the update of the local emergency response plan is provided by the HSERC and by the U.S. Department of Transportation Hazardous Material Emergency Preparedness Planning grant through the State Civil Defense; and WHEREAS, the annual Memorandum of Agreements between the HSERC, State Civil Defense, and the Hawaii County Local Emergency Planning Committee establishes the framework for funding of the project to update local emergency response plan of the Hawaii County LEPC; and WHEREAS, Hawaii Revised Statutes, Section 46-7, requires that county departments obtain the consent of the council to enter into agreements with the federal or state governments respecting action to be taken pursuant to any of the powers granted by law to furnish, expend, and receive any funds or other assistance in connection with projects being or to be undertaken pursuant to those powers. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that the Office of the Mayor is authorized to enter into an Agreement with the Hawaii State Emergency Response Commission and the State Civil Defense. ~E i°f FDI~~I~E~ i2~SC~~VED that the Mayor of the County of Hawaii is authorized to sign the above-referenced agreement and any related documents on behalf of the Office of the Mayor and the County of Hawaii pursuant to the Hawaii County Charter. ~E iT ial~~TiiE~ RESC)taVE~i that the County Clerk of the County of Hawaii shall transmit copies of this resolution to the Office of the Mayor, the Finance and Fire Departments, the Hawaii State Emergency Response Commission, Hawaii County Local Emergency Planning Committee, and the State Civil Defense.
