Arakaki, Chairman and Members of the County Council County of Hawaii 25 Aupuni Street Hilo, HI 96720 Dear Chairman Arakaki and Members: Initiator: Planning Director Amend Section 25-8-33 (City of Hilo Zone Map), Article 8 Chapter 25 (Zoning Code) of the Hawaii County Code - Waiakea The Planning Commission, after its duly held public hearing on October 17, 2002, voted to forward a favorable recommendation on the proposed amendment to Section 25-8-33 (City of Hilo Zone Map), Article 8, Chapter 25 (Zoning Code) of the Hawaii County Code, by deleting the proposed 80-foot Kawili Street right-of-way between Kino`ole Street and Kilauea Avenue, Waiakea, South Hilo, Hawaii. The favorable recommendation is based upon the following: The proposed amendment to the City of Hilo Zone Map involves the deletion of the proposed 80-foot wide right-of-way between Kino`ole Street and Kilauea Street. Presently, this segment of Kawili Street is an existing 60-foot wide right-of-way with delineation of the proposed 10-foot future road widening within parcels abutting on each side of the existing right-of-way. Transportation is the systems and modes of conveyance of people and goods from place to place. It can be considered the major infrastructural element of an area. The purpose of transportation planning is to provide faster, safer and more efficient travel. As transportation systems are expensive to construct and maintain, great care and foresight are needed in developing plans for them. The overall Transportation goals, policies and standards are set forth to physically plan the circulation in the County in the best interest of the island's residents. The reasons to support the deletion of the proposed 80-foot wide Honorable James Y. Arakaki, Chairman and Members of the County Council Page 2 Kawili Street right-of-way between Kino`ole Street and Kilauea Street would not conflict with the following goals, policies and standards of the General Plan's Transportation Element: * Provide a transportation system whereby people and goods can move efficiently, safely, comfortably and economically. * Provide a system of thoroughfares and streets for the safe, efficient and comfortable movement of people and goods between and within the various sections of the County. * Provide an integrated State and County system so that new major routes will complement and encourage proposed land uses. The Waiakea House Lots 2°d Series was created in 1923, with average lot sizes of 20,000± square feet. Those lots are bordered by Mohouli Street, Kino`ole Street, Kawili Street and Kilauea Avenue. Waiakea Homestead House Lots was created in 1918 with 1-acre size lots. Those lots are bordered by Kawili Street, Kino`ole Street, Haihai Street and Kilauea Avenue. Over the years, the parcels within both subdivisions were further subdivided, creating smaller residential lots. The subdivision was created with Kilauea Avenue and Kino`ole Street as the primary thoroughfares. Most of the dwellings in the subdivisions were constructed since the 1920's. The affected properties are primarily rectangular in shape with the lot dimensions ranging from 60 feet to 100 feet in width and 60 feet to 245 feet in length. Some of the dwellings on the affected parcels were constructed between 1924 and 1950, over 40 years old, but are in good condition for habitation. More recently, an apartment building was construction at the corner of Kawili Street and Kilauea Avenue and an office building at the corner of Kawili Street and Kino`ole Street. The Kawili Street segment between Kino`ole Street and Kilauea Avenue has been a 60-footright-of-way since the creation of the Waiakea House Lots 2"`~ Series. Ina 1924 tax map, the Kawili Street segment between Kino`ole Street and Mililani Street had been denoted as a 40-foot right-of-way. This road segment was subsequently improved to a 50-foot right-of-way. Construction of Kawili Street as an 80-foot right-of-way between Kanoelehua Avenue and Hinano Street was completed in the 1960's, in conjunction with the development of the Kanoelehua Industrial Lots Subdivision. Subsequently, the 80-foot right-of-way extension of Kawili Street between Hinano Street and Manono Street was constructed in the 1970's. Construction of Kawili Street as an 80-foot right-of-way between Kino`ole Street and Puainako Street was completed in the late 1960's or early 1970's. This Kawili Street segment fronts the Waiakea High School and University of Hawai `i at Hilo Campus. The City of Hilo Zone Map was also adopted reflecting roadway networks and circulation systems. Since its adoption by the Board of Supervisors on Honorable James Y. Arakaki, Chairman and Members of the County Council Page 3 December 26, 1968, the City of Hilo Zone Map delineates improved 80-foot Kawili Street right-of-way segments between Kanoelehua Avenue and Manono Street, and between Kino`ole Street and Puainako Street. It also delineates the Kawili Street right-of-way segment between Kino`ole Street and Manono Street as proposed 80-foot wide right-of-way. Hence, there is a proposed coati widening from the existing 50-foot to an 80-foot right-of-way between Kino`ole Street and Manono Street-Kawili Street intersection. Subsequent to the adoption of the City of Hilo Zone Map in 1968, the County Council adopted the General Plan, including Facilities Maps, in December 1971. Since then the South Hilo Facilities Map identifies Kawili Street as an 80-foot right-of-way alignment, with the segment between Kino`ole Street and Kawili Street-Manono Street intersection proposed to be widened and improved to 80 feet. The designation of a future road widening right-of-way within a parcel places building and other development restrictions on a property landowner which degree of impact varies depending on the amount and location of a right-of-way on the parcel. In this case, the 10-foot future road widening restricts the landowner from utilizing or developing the parcel to its best use. It should be also noted that with the proposed 10-foot future road widening, the parcel would be reduced in size and the Kawili Street right-of-way would be closer to some of the existing dwellings, specifically the parcels on the Puna side of Kawili Street. Further, it would require the County Co seek funds for the acquisition/condemnation of a portion of each of the parcels in order to widen and improve Kawili Street to 80 feet, and/or for the relocation of some of the existing dwellings and/or families. The Department of Public Works indicated that it had no objections to amending the City of Hilo Zone Map to delete the proposed Kawili Street 80-foot right-of-way segment between Kino`ole Street and Kilauea Avenue. Based on the foregoing, it is reasonable and fair to the public and to the private property owners to delete the proposed 80-foot wide Kawili Street right-of-way, between Kino `ole Street and Kilauea Street, as reflected on the City of Hilo Zone Map. The accompanying draft bill to amend Section 25-8-33 (City of Hilo Zone Map), Article 8, Chapter 25 (Zoning Code) of the Hawaii County Code, is provided for your favorable consideration. GENEIIAL INFORMATION 1. Land Ownership: According to the records at the County Real Property Tax Division, the parcels affected by the proposed Kawili Street 80-foot right-of--way are owned by the following individual landowners: Tax Map Key Name 2-2-26:1 Charles M. and Mary J. These subdivisions were created with Kilauea Avenue and Kino `ole Street as the primary thoroughfares leading into Hilo Town. 3. Kawili Street Right-of--Way: The Kawili Street segment between Kino`ole Street and Kilauea Avenue has been a 60-foot right-of--way since the creation of the Waiakea House Lots 2°d Series. Ina 1924 tax map, the Kawili Street segment between Kino`ole Street and Mililani Street had been denoted as a 40-foot right-of--way. General Plan Land Use Pattern Allocation Guide (LUPAG) Map: The General Plan Land Use Pattern Allocation Guide (LUPAG) Map designates the area as Medium Density Urban Development. 12. General Plan Facilities Map: Subsequent to the adoption of the City of Hilo Zone Map in 1968, the County Council adopted the General Plan, including Facilities Maps, in December 1971. Since then the South Hilo Facilities Map identifies Kawili Street as an -3- 80-foot right-of--way alignment, with the segment between Kino`ole Street and Kawili Street-Manono Street intersection proposed to be widened and improved to 80 feet. 13. Ililo Community Development Plan (CDP): The Hilo Community Development Plan, which was adopted by the Planning Commission in May 1975, also shows Kawili Street as an 80-foot right-of--way. 14. County Zoning: The County zoning designations for the affected parcels are mixed Neighborhood Commercial (CN-20), Multiple Family Residential (RM-1.5) and Single Family Residential (RS-10). 15. Zoning Code: Section 25-3-8 of the Zoning Code states the following: "Section 25-3-8. Legal effect of establishment of building lines, future ovidth lines, and plan lines. (a) Whenever a building line is established along any street on the zoning map, the minimum front yard for any affected property shall be equal to the distance between the street and the established building line. (b) Whenever a future width line is established on the zoning map, the future width line shall be considered to be the front property line of the affected property. The area between the future width line and the street (if outside the right-of--way) shall be deemed to be the street right-of--way, and cannot be considered in computing the minimum yard required on any building site. (c) Whenever plan lines for a future street have been established on the zoning map, the plan lines shall be considered to be the front property line, and the area between the plan lines shall be deemed to be street right-of- way. The minimum required yards of any building site shall be computed excluding any area within plan lines for future streets established on the zoning map." 16. Special Management Area (SMA): The subject area is not situated within the Special Management Area (SMA) of the County of Hawaii. DESCRIPTION OF TIIE SUDJECT AREA AND SURROUNDING AREA 17. Waiakea Ilouse Lots 2°d Series and Waiakea Iomestead house Lots Subdivisions: The Waiakea House Lots 2nd Series was created in 1923, with average lot sizes of 20,000+ square feet. More recently, an apartment building was construction at the corner of Kawili Street-Kilauea Avenue intersection, and an office building at the corner of Kawili Street-Kino`ole Street intersection. (See Exhibit D -Tax Maps) 19. Land Study bureau Report: Lands in the area are classified as Urban uses. 20. Agricultural Lands of Importance to the State of Hawaii (ALISII) System: Lands in the area are within the existing urban development. 21. Soil Survey Report: The soils in the area are classified as Olaa Series (OID) extremely stony silty clay loam, 0 to 20 percent slopes. The soils consist ofwell-drained silty clay loams that formed in volcanic ash. In a representative profile, the surface layer is very dark brown extremely stony silty clay loam about 16 inches thick and the subsoil about 9 inches thick, underlain by Aa lava. Permeability is rapid, runoff is slow and the erosion hazard is slight. 22. FIRM Map: The Flood Insurance Rate Map (FIRM) classifies the area as Zone X, areas determined to be outside the S00-year flood plain. 23. Surrounding Land-Use/Zoning: Surrounding lands are primarily in single family residences and zoned Single Family Residential (RS-10). The 7-Eleven Store is located at the corner of Kawili Street-Kino`ole Street intersection and is zoned Neighborhood Commercial. The University of Hawaii at Hilo Campus and Waiakea High School complex are situated about a block west from the Kawili Street-Kino`ole Street intersection and the area is also zoned RS-10. The State of I-Iawai`i Division of Forestry OfficeBaseyard and the Hilo Nursery and Arboretum site are located at the corner of Kawili Street-Kilauea Avenue intersection and is zoned Open. The Hawaii Community -S- College Campus is located further east about a bloclc from the intersection and is similarly zoned RS-10. Industrial zones and uses are established on both sides of Kawili Street between Manono Street and Kanoelehua Avenue. Generally, the Waiakea House Lots 15` Series area is primarily in residential uses. PUBLIC FACILITIES AND SERVICES 2~. Roadway: The intersections of Kawili Street-Kino`ole Street and Kawili Street-Kilauea Avenue have been improved with signalization and are channelized, providing traffic movements in the area. 25. All essential public facilities and services are available to the subject area. PUBLIC COMMENTS 26. Harry and Paula Sumida are in support: (See Exhibit E -September 18, 2002 Letter) 27.
