Deaz Chairman Arakaki and Council Members:
On April 2, 2001, members of my administration and I met with Ray Soon, Chair,
Department of Hawaiian Home Lands (DHHL), and his staff for the following purposes:
• To establish a working relationship between the DHHL and the County of Hawaii;
and
• To discuss issues of mutual concern and develop a Memorandum of Agreement that
addresses these concerns.
After holding numerous meetings with the community and each other, we believe we
have accomplished both purposes.
Enclosed for your review is a copy of the completed Memorandum of Agreement (MoA)
between the County of Hawaii and the Department of Hawaiian Home Lands. It serves
to clarify respective roles, responsibilities, and obligations relating to land use planning,
infrastructure maintenance, enforcement of laws, and collection of taxes and other fees on
Hawaiian home lands.
Please note that the settlement of delinquent taxes in Section VI has already been
accomplished. Resolution 146-01 of the Hawaii County Council authorized the Director
of Finance to compromise the penalties and interest owed by lessees of Hawaiian Home
Lands according to the terms of the MoA. The Depaztment of Hawaiian Home Lands on
Apri19, 2002, paid the County of Hawaii $506,583.13 in delinquent taxes.
The Hawaiian Homes Commission unanimously approved the MoA at its October 2002
meeting in Hilo. Also enclosed, for County Council action, is a proposed resolution
authorizing the Mayor to enter into this same MoA. Comm. No.

We respectfully request that referral of this Resolution to the Council Finance Committee
be waived so passage may take place prior to the departure of Ray Soon from the
Department of Hawaiian Home Lands. Ray has been instrumental in the development of
this MoA.

RE: Resolution No. 19-03 Authorizing a memorandum of agreement between
the State of Hawaii Department of Hawaiian Home Lands and the County of
Hawaii with the respect to county services and delinquent real property taxes.
Pursuant to Section 1(g) of Rule 4 of the Rules of Procedure of the Council of the County of
Hawaii, this written request is submitted with my approval that the above-referenced matter be
waived from the Committee on Finance to the full Council for immediate action. In reviewing
this matter, timely approval is crucial It is therefore advantageous that approval is granted and
the matter placed onto the next Council agenda for review. However, in the event this request is
denied, for whatever reason, 1 understand the matter shall be referred to the Committee on
Finance for placement on its future agenda.
