Enclosed is a copy of our November 22, 2002 memorandum to the Planning Department requesting
clarification/corrections to their September 27, 2002 memorandum to Lincoln Ashida and a copy of their
response. We hope this clarifies that no new improvements are being provided or dedicated save for the
existing road.

The memo sent to Lincoln Ashida, Corporation Counsel, dated September 27, 2002 erroneously
referred to road and drainage improvements for the subject subdivision. The subject dedication
merely corrects an existing encroachment, and we accordingly recommend approval.

SUBJECT: DEDICATION DEED -ROAD ENCROACHMENT

At the November 19, 2002 Committee on Public Works, Councilperson Tyler made issue of a
September 27, 2002 Planning Department memo to Lincoln Ashida. The memo stated that all road and
drainage improvements had been completed according to Chapter 23. This contradicted our testimony
that there is no improvements because the purpose of the subdivision/dedication was to correct an
encroachment of an existing County road.
Apparently this misunderstanding arose because a form memo was used that did not consider the
purpose of the subdivision and the deed. This is not a typical road dedication but is really a donation.
Whenever an owner is willing to donate his property to correct an encroachment, DPW provides
surveying and other related services on his behalf
Please act accordingly to clarify/correct the statements made in your September 27, 2002 memo. A
prompt response will be appreciated so I may clear up this matter with Councilperson Tyler before the
December 18, 2002 county council meeting in Kona.
