Subject -Bill 277, Draft 5, Relating to Animals
This is A~ctremely Important legislation and it should be well though out before passing.
I have tried for 11 years to make some of these changes. So please take time to
carefully review. Working in animal welfare for over 20 years, including having been an
animal control officer I have a hands on perspective.
The following are some changes I would propose. NEW MATERIAL IN CAPS.
Article 1-Definitions
Page 2 Under (b) Please add the following;
(1) Hunting dogs that trespass on other's property and attack and kill animals shall be
subject to alf laws pertaining straying and dangerous dog regulations and therefore
cannot be used for hunting again.
(f) Proposed - "County animal control service" means animal control services provider
contracted by the county to keep stray or unlicensed dogs. (please add) AND OTHER
ANIMALS
(i) Proposed - "Farm animals" means pigs, cows, goats, sheep, horses, camels
and llamas. Please add AND POULTRY.
(p) "Provocation" Under section (6} Proposed - the dog was protecting itself, its
kennels or its offspring from the attacked person or animal and the attack was
committed on its owner's property. This should read IF A PERSON, WHILE ON
ANOTHERS PROPERTY SHOULD ATTACK A PERSON OR ATTACK AND ABUSE A DOG
AND OR HER PUPPIES ONLY THEN WOULD THE DOG BE JUSTIFIED IN ATTACKING 70
DEFEND ITSELF ITS MASTER AND THE PUPS. (Someone simply walking to the front
door could be Interpreted by some dogs as a threat, I know, this happened to me!!!)
(q) Proposed - "Serious Injury" to a domestic animal means physical Injury
to the animal Involving a broken bone, a laceration requiring stitches, a
concussion, or a tearing or rupture of an organ. It should read .....a
laceration, (drop requiring stitches, a wound is sometimes pulled
together with tape) Please add OR PUNCTURE WOUNDS OR VIOLENT

SHAKING. Thus it should read "Serious Injury" to a domestic animal
means physical injury to the animal involving a broken bone, a
laceration, a concussion, a tearing or rupture of an organ, PUNCTURE
WOUNDS OR VIOLENT SHAKING.
Page 3 under [(f)j the length of the teach should not be 8 feet. The person holding the
leash should be capable of controlling the dog. It should read..,.. chain or other means
is not more than 6 (SIX) FEET IN LENGTH AND UNDER THE CONTROL OF A PERSON
ABLE TO HANDLE THE DOG.....(To walk the dog in residential areas, 6 feet Is adequate.
8 feet would just mean the dog would stray more into people yards.)
Sectiorr~-31 Regulation of Dangerous...see page 6 under
(d) (3) (a) Please add CHANGE OF OWNER SHALL NOT CHANGE THE REQUIREMENTS
FOR PROPERLY KENNELING THE DOG.
Page 7 under (4} Proposed -The owner shall obtain a license for the dog pursuant to
HRS Section 143-2, if the dog is not currently licensed. Please add SMALL BE CITED
FOR NOT HAVING A LICENSE AND FOR STRAYING IF NOT AUTHORIZED TO BE ON
THE PROPERTY WHERE THE ATTACK OCCURRED.
(5) Proposed -When indoors, the dog be attended and kept on a leash no longer than
6 feet in length and under the control of a person 18 years of age or older; please add
AND BE STRONG ENOUGH TO CONTROL THE DOG.
Under (12} page 8 this has to do with the type of structure a dangerous dog should be
kept. Please add at the end of this section the following. SOME DOGS MAY REQUIRE
CHAINLINK OR FENCING TO EXTEND TO THE ROOF IN ORDER TO KEEP THE DOG
FROM CLIMBING OUT.
Please add under (12) page 8, after the description of type of housing, the following;
(1) THE ANIMAL CONTROL CONTRACTOR SHALL BE RESPONSIBLE FOR
MONITORING THE DANGEROUS DOGS FROM TIME TO TIME, TO VERIFY THAT
THEY ARE BEING KENNELED PROPERLY AND NAVE PURCHASED A MUZZLE.
Page 9 under Section 4-31.1 Citation and Summons... Please add another item
(f) THE DOG SHALL REMAIN IMPOUNDED UNTIL THE OWNER PROVIDES A PROPER
KENNEL.
(g) THE PERSON HANDLING THE DOG SHOULD BE ABLE TO CONTROL THE DOG.
AGE ALONE SHOULD NOT DETERMINE A PERSONS ABILITY TO CONTROL A DOG.
