SUBJECT: GRADING VIOLATION
Location: Kalahiki -Waiea, South, Kona
TMK: 3/8-06-08:02and3/8-06-11:03
Our attention has been called to the grading work recently performed on the subject property. A
search of our records shows that neither a grading nor grubbing permit was issued for this work.
You are directed to cease any further work on the subject property until this matter is resolved.
You may resolve this violation by submitting a completed copy of the enclosed grading permit
application form within thirty (30) days of the above date. Three (3) sets of grading plans
prepared by an engineer or land surveyor will accompany the application as required by Chapter
10, Erosion and Sedimentation Control, of the Hawaii County Code.

record of burial / and someone was to push it, then there was never any there to begin with) State Historic
Preservation Divsion, Keala Lindsey (Burial Council), DLNR continues the onslot to erase the history of

According records of the Great Mahele (Land Division) these families resided and have links geneologicaly
to those tetriains unearthed at Kalahiki:
Oopa Ohana, Namaka Ohana, Milahaka Ghana, Naipu Ghana, Kuoha Obana, Kawaha Ohana, Kapipaka
Ohana, Kapala Ohana, Kaoliokalani Ohara, Kaninui Oban, Kanakaole Oahana, Kamailobi Ohana,
Kaluailama Obana6 Kaum Ohana, Kahuokua Ohana, Kaholoikopu Ohana, Pakui Ohara, Pahua Ohana,
Hoopuba Ghana, Elehiwa Ghana, Apela Ohana, Anae Ohara, Alapai Ohana, Puhi Pau Ghana.
All avenues for remedy was exbausted when Mayor Deputy Peter Young was notified by members from the
Alani Ghana and Pai Ghana.
Why is this being allowed to continue today?

At 3:05 p.m. Officer R. Sakata hands me a piece of paper with a
couple of numbers on it, the numbers of the State Historic Pres-
ervation Division, and the Department of Land and Natural Resour-
ces. At which time I replied it is because of these specific
agencies, at I have come, for nothing happens. And Officer R.
Sakata responds with his head tilted, and both hands held chest
with opened palms replies "Sorry I cannot help you."

Office of the Mayor, Sir I'm here again on
behalf of Our families. And I've just come from the Captain
Cook Police Station, and the Kailua, Kona Police Station, and
have to tell you as distrubing as it seems, I'm now here to
inform you and your office that the Violation that was issued by
the County of Hawaii Engineering Division Chief, Galen M. Kuba.
And that.the bulldozer involved, had in fact moved from where
it had been a few days ago. As shown in video fooatge, but the
disturbing part of this particular day, was the discovery of
more Family remains under and around the metal tracks of this
bulldozer.

On my way to the rubbish dump, Traffic slowed
to a stop when traffic began to clear, I noticed that it was the
Pro)erty belonging to Vernon and Noe Noe Lindsey's residence,
that same TMK 3/8-06-08:02 and TMK 3/8 -06 - 11 - 03 that was
cited with the violation from The County of Hawaii Engineering
Division, signed by Engineering Division Chief Galen M. Kuba.
I noticed that the tractor trailer was in the process of off-
loading a Komatsu Bulldozer about four times the size of the one
that had excavated our Families Sacred Burials.
Decmber 11, 2002 4p.m.
Fronting Pearls Farm and Garden Supply I
was yelled at by Lino Kamakau enforcement officer of the Division
of Conservation and Resource Enforcement. Lino stated to me
he's doing me a favor, because he is in charge of my case, and
that Maryann Maigret Archaeologist with the state historic
Preservation Division says that I'm in violation of two specific
violations.

Pearls Farm and Garden at Kealakekua
Shopping Center, told me that Lino Kamakau A DOCARE Enforcement as
agent mentioned to her that she signs she had posted, were in
fact in violation of laws that he would have to enforce. So In
fear of these violations Pearl removed the signs.

Dear Mr. Kuba:
Kaulana O Kalahiki `Ohana would like to respond to your November 27, 2002 certified letter to
Mc Candless Properties regarding grading violations at Kalahiki - Waiea, South Kona.
Please take notice that Kaulana O Kalahiki `Ghana objects to the Department of Public Works
granting a grading permit application to Mc Candless Properties. Due to the cultural sensitivity
of burial treatment protection and preservation, Kaulana O Kalahiki `Ohana strongly urges the
Department of Public Works to refrain from resolving this matter by having McCandless
Properties submit for approval a completed grading permit application.
It is the `Ghana's position that until such time as the matter of known burials located on the
properties and the extent of damages which have taken place illegally are properly assessed by
the State Department of Land and Natural Resources, no further grading or land alterations
should be allowed to proceed upon the properties.
Kaulana O Kalahiki `Ghana will seek any and all remedies and/or penalties available under the
law for the illegal desecration of burials and sacred sites.

11-15-02 Kona office received a call from Brad Pai (cell #640-2232), who wanted to
report gravesites being bulldozed in the Waiea area. B. Pai stated that he was in
possession of videotape evidence of the possible violations. I spoke with you, and
confirmed that I should ask B. Pai to come to our office so SHPD-Staff could view the
videotape. I returned a call to B. Pai's cell phone #, and left a message asking him to
return my call.
11-25-02 Brad and Kathleen Pai arrived at our Kona office. B. Pai offered SHPD-Staff
the opportunity to view a videotape he had.
The videotape was filmed by Brad and Kathleen Pai on or close to November 15, 2002.
B. Pai followed the general path SHPD followed on November 6, 2002 site visit (see Doc
No. 0211k102). The video does show some areas that SHPD did not visit on 11-6-2002.
Video ends with B. Pai in Waiea.
-B. Pai narrates most of the video, often referring to "mass burials and
gravesites", but the video at this point is shaky, and the camera is being moved
very quickly. I don't know what features are being described.
-The end of the tape shows Kathleen Pai holding four bone fragments in her hand.
After viewing this scene twice, SHPD archaeologist J. Knapp confirmed that one
of the fragments shown is a possible human mandible. The B. Pai indicated that
there are "buckets" of additional human remains at the site. Exposed remains had
been covered, but left at the site.
-This area is described in my first site visit memo. 2 acres plus in size,
already been grubbed, some areas graded. Not sure of permit status.
Landowners are Vernon and Noenoe Lindsey (ph # 579-8843). I think
area is just into Waiea.
-There is some question regarding the landowner currently listed
(McCandless properties) according to Tax Map records, and who is
responsible for the current activities (Vernon and Noenoe Lindsey) taking
place.
I spoke with you again after Brad and Kathleen left our office. I was to do the following:
1. conduct site visit as soon as possible with DOCARE officer and SHPD
archaeologist.
2. take any confirmed human remains into SHPD possession and temporarily
curate at SHPD-Kona office.
11-27-02 Today I had telephone conversations with:
I. Richard Omija (County Inspector ph# 327-3530), who told me that he had briefly
visited the area yesterday. I asked him about the large bulldozed area in Waiea-
he told me he had not seen it. R. Omija was willing to coordinate an additional
site visit with SHPD- Kona staff.
2. Bob Rechtman (Rechtman Consulting ph# 966-7636). B. Rechtman said he did
do some work for V. Lindsey. The work was monitoring a road cut that V.
Lindsey said he had a permit for. This road cut was well mauka of the larger area
in question. B. Rechtman did say that he told V. Lindsey that additional grubbing
or grading would require additional permits.
3. Keith Unger (McCandless Ranch ph# 328-8246) who emphasized that the land in
question did not belong to McCandless Ranch, and the bulldozing activity in
question was being done by Vernon Lindsey. K. Unger did agree to allow DLNR
and County personal access to the area via a McCandless Ranch road.
4. Charles Nahale (DOCARE West Hawaii Supervisor ph# 3274960) who agreed to
assign a DOCARE officer to accompany SHPD-Kona Staff on a site inspection.
5. Brad and Kathleen Pai. After I told them DLNR and County personal would be
visiting the area, I was told by B. Pai that the entire area was kapu, and that no
person should enter without the permission of the family.
I spoke with you at the end of the day. My plan was for a site visit on Friday morning
11-29-02 Met K. Unger at Old Government Road/Ho'okena Beach Road. R. Omija, and
M. Maigret met me there. Because DOCARE was short on manpower today, a officer
was not present. The County has put in a chain-link gate that prevents access to the Old
Government Road (OGR) going south (it connects by the Waiea dump). K. Unger
opened the chain-link gate that allowed us access to the OGR, and then opened an
additional iron ranch gate that allowed us to travel makai off of the OGR. The road
running mauka-makai is on McCandless Ranch land. I was told that the Pai/Alani family
has cut an access road (through McCandless Ranch property) that bypasses the
aforementioned gates, and then ties in with the McCandless Ranch road running makai.
Brad and Kathleen Pai, and Lewis Alani were waiting for us down below.
I noticed the Pai/Alani Family were equipped with a video camera and a small tape
recorder. SHPD-Kona Staffs activities were videotaped (until the battery died), and
conversations recorded.
Met Pai/Alani Family at border of McCandless Ranch property and Vernon and Noenoe
Lindsey's property. Proceeded into Waiea and the Lindsey property. I was lead to an
area 19.3m (E -W) by 18.2m (N -S). Rocky banks drop sharply, approximately 2m from
grade on the north, west, and south. The east side is defined by a steep Pali. The floor
consists of loose rock and soil deposits. The excavated area is only visible when an
observer is within close proximity. Area has been heavily impacted by bulldozer activity.
Initially M. Maigret was not allowed into the "kapu" area designated by the Pai/Alani
Family (the excavated area, containing possible human remains). I was allowed to
proceed with a visual inspection of the area.
Visible on the floor of the excavated area are four rock platforms (1.5m by 1.5m) which
have been recently constructed by the Pai/Alani Family. B. Pai informed me that these
platforms mark the areas they felt had the most heavy concentrations of remains All
remains they had collected from the surface had been re -interned in these platforms (after
being placed in lauhala baskets). I asked the Pai/Alani Family if I could possibly look in
the lauhala baskets. I was informed that disturbing the platforms was not an option
available to me.
As I walked along the southern bank, observed one bone fragment (possible long bone),
and a intact vertebra- left them both in place. Walked back towards the west side of the
platforms, and observed a soil deposit. Saw one bone fragment, barely visible on the soil
surface. Began to clear away soil, and found more bone fragments. Thought that this
might be a in-situ location, and felt that M. Maigret needed to verify and document
remains identified, and context of this burial.
The Pai/Alani Family decided to "lift the kapu" on the area. M. Maigret was allowed in
to begin her documentation. Human remains were positively identified by M. Maigret
(see DOC NO 0212mm01). After excavating approximately 10 cm of loose soil, possible
in-situ rib Fragments and a possible scapula were identified. Soil around these remains
was compact, and black and gray "staining" was observed. This location is marked by a
stack of loose rocks. Collected remains were placed next to the possible in-situ location
and also marked with a pile of stones.
The Pai/Alani Family strongly objected to the removal of any remains from the area,
regardless if they were to be used as evidence. Therefore, no remains were collected by
SHPD-Kona Staff.
County Inspector R. Omija left before us, and I am not sure if he determined there were
county violations.
12-02-02 B. Pai telephoned our office to again state that the entire burial area was kapu,
and no person should enter without the families permission. He went on to state that the
kapu had been broken by Keith Unger, and Maryanne Maigret's presence at the site on
Friday. Kathleen Pai stopped at our office and said the same thing her husband said. K.
Pai also requested any SHPD staff reports or memos on this subject.
Trying to get in touch with Charles Nahale (DOCARE) to arrange a site visit by a
DOCARE officer.

Re: Site visit to Kalahiki, South Kona

November 4, 2002 I met with Kathleen Pai (Alani), her husband Brad, and George
Kinimaka regarding some concerns they had regarding the Kalahiki area. Bulldozing
activity may have impacted possible burial sites. Preservation and protection of sites
from future development activities was discussed. I explained the process of registering
burial sites. K. Pai stated that her father, Lewis Poli Alani, a lifetime resident of
Kauhako/Kalahiki would be able to give more detailed information regarding possible
burial sites. I was unable to find any documentation on the subject property in our Kona
office files.
Because possible burial sites might be in immanent danger, and because an informant
was willing to share information, I decided a site visit should be conducted as soon as
possible.
I telephoned McCandless Ranch (landowner) and spoke with Mr. Keith Unger (Ph # 328-
8246). K. Unger stated that McCandless Ranch was actively working with DLNR- Land
Division regarding conservation district use violations in Kalahiki. Bulldozing had taken
place a few months ago (July?) on an old ranch road, but had ceased. K. Unger did not
know anything about burial sites being destroyed or damaged. The only active
bulldozing K. Unger knew about in the area was on a neighboring property in Waiea.
McCandless Ranch has been consulting with a contract archaeologist about possibly
conducting an inventory survey to determine what burial/archaeological sites are present.
I informed K. Unger of the pending site visit with informants that might have knowledge
of burial sites on the subject property.
November 6, 2002 met Lewis Poli Alani (informant), Kathleen and Brad Pai, and George
Kinimaka on Old Government Road above Kalahiki Village. Jeanne Knapp (SHPD-
Assistant Archaeologist) was also present. The following is a summary of burial and
possible burial sites that I observed during our time in the area, any information that L.
Alani provided is also noted.
Site #1- Cave burial (multiple individuals)
Located in cliffs near ocean north of old Kalahiki Village. L. Alani stated that this cave
contained numerous human remains that were "just piled in there". Since the last time he
had been to this site, the rock out -cropping above the cave has collapsed. Tons have rock
have fallen from the cliffs above. Human remains could still be seen in what remained of
the cave. Area is very unstable. Although further investigations may be warranted,
persons will be in extreme danger.
Site #2- Platform (possible burial) approximately 3x2m 1 m high.
Good condition. Ranch road located about 1 m east of site. Appears as though unknown
persons have dug two shallow pits into the feature.
Site #3- Platform (possible burial) approximately 3x3 lm high
Good condition. Northwest of site (30m) there are five smaller platforms all in good
condition. Two platforms in poor condition were observed 3m and 5m to the southeast.
A large enclosure (possible house site?) is located immediately south of the site.
Site #4- Possible burial- Old Kalahiki Village
Site is possibly on border between TMK (3)8-6-14:7 and parcel 8. Landowners listed in
TMK book I have as Thomas G. Rietow (parcel 7) and Charles K. Hosea Estate (parcel
8). There may be archaeological information on the Rietow property in our Hilo office.
L. Alani pointed out an area that he remembers being a possible gravesite. Observed
what might be part of a rock alignment that at one time might have delineated a possible
gravesite.
Site #5 — Possible Burials- Old Kalahiki Village
TMK is (3)8-6-14:6, landowner listed as Marmionette L. Kaowili. L. Alani remembers
coming to this specific area as a child. He remembers lots of low rockwalls, that
delineated individual gravesites. No one ever told him these were gravesites, but he just
knew they were, and respected the area. L. Alani recalled that in the 1950's, heavy rains
caused floods that came from mauka all the way to the shoreline. The water collected in
this area, and filled it with dirt. The area is now overgrown with shrubs and grass, and
during our site visit, we could not find any evidence of gravesites on the surface.
Site #6- Possible Burial Crypt
Site is located approximately 35m east ofTMK (3)8-6-14:7. L. Alani remembers
walking the trail to the ocean as a child, and seeing this site. He always assumed it was a
gravesite of one of the families from the area. L. Alani stated that the feature had cement
walls and a curved roof, and it always caught his eye as he walked by it. Portions of a
low rock wall still visible around the feature. The feature is currently in poor condition.
Only part of north wall is still intact, and there are numerous pieces of the structure
scattered throughout the area. At one time feature might have measured approximately
3x2m 1.5m high. The interior of what is left of the structure is filled with rubble. I did
observe what looked like pieces of milled wood mixed in with the rubble. I could not
determine the relationship between the wood pieces and the site feature
During our site visit, we walked along the Kalahiki/Waiea border, and observed a large
bulldozer (D-99) actively grading what appears to be a house pad in Waiea. A larger area
(5 acres plus) has already been grubbed. Information provided to me indicates the
landowners are Vernon and Noenoe Lindsey. I have not been able to determine if a
permit is necessary for the work taking place.
November 7,2002 I spoke with Keith Unger (McCandless Ranch) about our site visit the
previous day. Informed him of the cave burial. K. Unger indicated that McCandless will
be hiring a contract archaeologist soon to conduct an inventory survey of their lands in
the area. I spoke with him about the additional sites that are considered possible burials.
November 12, 2002 I spoke with Debbie Chang (County Planning Department)
regarding the bulldozing in Waiea. D. Chang recalled Vernon Lindsey coming into the
Planning Office to inquire how to get a grubbing/grading permit. There is no record in
SHPD-Kona or at County Planning of a grubbing/grading permit being issued to V.
Lindsey. Land V. Lindsey is actively working on is Agriculture zoned.

On Friday, November 29 I conducted a site visit to the subject property to determine if
human skeletal remains were present at a recently bulldozed and excavated location. The
person responsible for this property is Mr. Vernon Lindsey I was accompanied by Keola
Lindsay, and Richard Onija (Hawaii County). We met briefly with Mr. Keith Unger
before entering the property. Also present were Kathleen Pai, Louis Alani, and Brad Pai
We began our site visit at 8:00 a.m.
The total area that has been disturbed by recent bulldozing is 225 meters N -S by 50
meters E -W, or mauka-makai. Total acreage is roughly 3 acres. The seaward portion is
grubbed only (see attached map), while portions of the mauka area adjacent to a cliff, or
pa/i have been more extensively graded or excavated. I systematically walked across the
grubbed area No midden scatters or artifacts were noted. Damage was extensive to the
ground surface. No archaeological features were noted.
Keola accompanied the Pai/Alani family members to a 19m x 18 meter excavated sink,
resembling a casserole dish, situated in the northeast portion of the disturbed area,
directly adjacent to the pari which is roughly 50 feet high and vertical. While I made the
sketch map, Keola assessed the situation in the sink area.
I joined the group a short time later. The floor of the excavated sink consists of both
scraped, crushed solid basalt rock and areas where deeper soil deposits are present. The
soil area is adjacent to the pati, while the rockier area is in the more western, makai
segment. Four small stone platforms have been constructed in the soil area by the
Pai/Alani family. They explained that the platforms were built over concentrations of
human bones.
A total of 28 bone fragments and 2 human teeth were located in the soil area. Due to the
highly disturbed soil deposit, it was not possible to determine immediately where the
fragments had originated. In the initial identification of fragments that were present in the
loose, disturbed soil, I identified a thoracic vertabra, clavicle, mandible (partial, left side
only)with two intact worn teeth, sternum, and several rib fragments Two human molars
were also present, unattached to any skull or mandible fragments. I could not identify all
the fragments with certainty.
We whisked-broomed an approximately 1 meter square area where the most fragments in
loose soil had been located. Once we removed approximately 10 centimeters of loose,
extremely powdery soil, we came down on a slightly more compact soil deposit with red,
black and gray staining suggestive of soil in a pit feature. An in sini scapula was located,
as well as several rib fragments that were firmly in place in the soil. Soil deposition on
the scapula was compact. I could not tell if the remains were flexed or extended. The
proximity of rib fragments to the scapula suggests an articulated skeleton but the degree
of disturbance is so extensive that I cannot yet be sure.
All surface archaeological features, if there were any, have been destroyed. No
archaeological context is intact except for what I feel may be a soil pit in which the
remains were placed. Approximately 2.5 meters to the north of these in situ remains,
there is another roughly 2 x 2 meter area where the soil color is distinctly different than
the surrounding area. Were further exploration deemed necessary, I would check this
area.
The remains are likely Hawaiian and older than fifty years. A determination of number of
individuals is not possible at this point because numerous fragments have reportedly been
interred into the four small platforms by the Pai/Alani family and an examination of these
interred remains was strongly objected to by the Pai/Alani family.
The in .sine remains were covered with small cobbles. The fragments that had been
gathered from the loose soil were placed in a ring of cobbles and covered with stones.
We left the site at approximately 12 noon
