Traffic Regulation on Private Streets
Section 24-12 imposes an obligation upon the police department to enforce all street
traffic laws of the County. This obligation maybe impracticable to carry out when a
private street is in such poor condition that it may not be traveled by the police without a
significant risk of damage to police vehicles or injury to police personnel.
Consequently, I propose addition of the following language to the bill that would enable
the police and the department of public works to inform the council of streets that are in
such poor condition that they may not be safely traversed by the police.
SECTION Chapter 24, article 1, section 24-8, Hawaii County Code 1983
(1995 edition), is amended to read as follows:
"Section 24-8. Council to exercise certain functions by ordinance.
(a) The council shall by ordinance:
(1) Determine and designate the type of all official traffic control
devices; provided, such official control devices shall, with respect
to size, shape and color, be uniform, shall correlate with and
conform to, the system then current, as approved by the Federal
Highway Administration, U.S. Department of Transportation.

(2) Create, define, redefine, eliminate or change all speed zones, safety
zones, quiet zones, crosswalks other than at intersections, freight
and passenger loading and unloading zones, no-parking zones,
time-limit parking zones, parking meter zones, tow or tow-away
zones, bus stops, U-turn areas, prohibited U-turn areas, prohibited
left and right turns, one-way streets, through streets, stop
intersections, roadways closed to pedestrian traffic, and roadways
closed to certain classes of vehicles.
The council shall not impose or may repeal traffic regulations upon a
privately owned and maintained street, highway, or thoroughfare (street),
if both the chief engineer and the chief of police notify the council in
writing that the street is either not constructed or not presently in a
condition that would allow the police department to traverse such street
without the significant probability of either resultant damage to their
vehicles or resultant personal injury.

appreciated.
