SUBJECT : BASIL'S RESTAURANT
Sidewalk Use Permit
The Department believes that there is insufficient authority in Chapter 22 of the Hawaii County Code to
consider the subject request. To address this and other weaknesses in the Chapter, the Department had
submitted a revision currently identified as Bill No. 262. Although the revision permits consideration
of this type of matter, the applicant must still show, to the satisfaction of the Chief Engineer, that the
request would not interfere with the safe use of the public walkway. In this case, we would not support
this action as employees from Basil's must cross or maneuver azound pedestrian traffic. We believe this
to be an inherently hazardous situation regardless of the amount of care exercised by Basil's employees.
