January 21, 2003 Hawaii County Councilpersons c/o Bobbi Jean Leithead-Todd via fax:961-8912 Re: Bill 38 and Bill 39 Council Committee Meetings January 22, 2003 Dear Councilpersons, You have on your agenda today a request to rezone property that is presently zoned 5 acre agricultural. The property owners ask that it be re-zoned single- f3~nily residential lots. We own a home that adjoins and borders this property. We do not oppose re-zoning for single-family homes. We support it. We realize that growth and development is inevitable. As the population of Kona grows, there will be a need for additional housing units to accommodate the growth. We applaud the action that the County Council took last year in repealing the provisions of CPR in spite of very strong objections from developers and the real estate community- The CPR was used and abused to develop residential housing without the developer investing monies to insure that he improves the infrastructure (traffic, schools, utilities etc.) to support the incremental growth.. . We request that the devebper's application for re-zoning be sanctioned and approved with the proviso that the applicant will fund the following quantifiable and measurable infrastructure improvements: The grading of the land for the housing units does not in any way interfere with the drainage and proper rurnoff of water that eventually retches the bay. There must be an environmental study that demonstrates that this construction does not impede drainage, and does not contaminate the bay. • The increased traffic based on two cars or more cars for each household is a major concern. Melelina Street is a narrow road and at present is the only outlet. It feeds traffic onto Nani Kailua, which is an over-burdened residential street intersecting Queen Kaahumanu Highway. In addition, ft would be imperative that the street servicing the new development terminate in a cut de sac. A street that is designed to feed into future roads would cause severe traffic congestion, again, on over-burdened Nani Kailua. Comm. No+. ~ I31e No. L- Ref. xe:. The capacity for each should increase as the number of housing units increase. Those incremerrtal costs, which are not paid by property tax, sales tax, or state income tax, needs to be in the cost of the home. The developer must pay for them up front or make the improvements. • The developer must produce enforceable CC&Rs that not only protect the quality of life for the people buying the homes, but also insure that the neighboring developments are protected so their present quality of Iffe is not diminished. Thus, height of structures and height of trees and plants which can obstruct ocean views for example, shouk be prohibited by well worded and legally enforceable CCB~Rs which are on record with the County, and available to the public. The repeal of the CPR by the Council was not ancillary and decorative, but enacted to insure that we would help our island stem haphazard growth. Therefore, we hope that you will insure that this applicant, and all other applicants, pay their fair share to maintainlmprove our quality of life on this island. We do not oppose smart growth. We oppose unbridled growth unsupported by infrastructure improvements that resuk in squalor and produce ghettos.
