TMK: 7-5-18:8 Dear Mr. Arakaki, I have received a document which I believe will be on the Hawaii County Council agenda for the January 23rd Council Meeting. It is the Proposed Bill No. 3, Draft 3. My interest in the project is as President of Kona Pacific Homeowners Association. Our association has been in discussion with Sunstone Realty Partners previously and did agree not to further contest their plans as a result of a settlement and withdrawal from a contested case hearing. The settlement was essentially a plan to allow for a protected walkway along the front of our property on Walua Road to Alii Drive. To my knowledge this is still in place. After reading the document 1 had some unanswered questions, and contacted our local planning office and spoke with Mr. Daryn Arai. My concern was with Paragraphs E. 1. and E. 3. Quite specifically I wanted a more precise interpretation of Section E.1 which states, "Improve that portion of Ali'i Drive and Walua Road in the immediate vicinity of the project site to collector street standards." My concern was that it would mean widening the road to 60' feet from the applicants property to Ali'i Drive. Were that to happen it would mean the taking of a large portion of Kona Pacific Property fronting on Walua Road. It is my understanding after talking with Mr. Arai, that at this time the expansion to collector street standards only applies to the section of Walua Road generally bounded, North and South, by the property lines of the Applicant's property. At this time there is no intent to move the collector street status further North on Walua Road past Kona Mansions and past Kona Pacific. If there is any impact, according to Mr Arai, it would be as a result of transitioning the road from 60" to the existing 40' or 50'. As part of this application there is no intent to acquire property from Kona Pacific. With regard to item E.3., Mr. Arai explained that this was tied to E.1, and was again not meant to extend to Ali'i Drive on the mauka side of Walua Road. Thank you for your attention to this matter.
