Attached for your favorable consideration is proposed Bill No. 39, Draft 3, which includes the
following amendments:
1. Condition C. Deletes the phrase "the northern boundary of the" and replaces it
with "a cul-de-sac within the". Also replaces the word "demanded" with
"requested" in the last sentence.
2. Condition I'. Expands the fair share contribution language to ensure it is
applicable to all additional residences on a lot. It also clarifies what was
"understood' that only residential lots without a dwelling or valid residential
building permit will be assessed the fair share contributions.
3. New Condition R. Inserts new language "To address community concerns over
speeding at Nani Kailua Drive, afour-way stop shall be installed at the
intersection of Nani Kailua Drive and Kakalina Street. The impact of this
improvement shall be evaluated by the Department of Public Works in
consultation with the Kona Traffic Safety Committee for asix-month period. At
that time the Department of Public Works will report to the Council to determine
if the improvement will remain."
