Mark Ferias - Badge#253 9/,~~~OU~ #2 -Performance of Duty -The investigating officer has been recognized as an officer who had participated in prior searches on my home, which tells me that o$rcer Ferias had prior knowledge of our residence being a medical marijuana location. On April 16, 2002, Acting Police Chief Lawrence K Mahum, acknowledged and signed Rules and Regulations Governing Investigations Involving The Medical and Religious Use of Marijuana. Page 4, section B specifically states: Search Warrants. Before seeking a search warrant, an officer shall check with the Department of Public Safety, by name and/or location, to determine whether the person under investigation has been issued a registry identification certificate. I) If the Department of Public Safety indicates that the person under investigation is currently registered or that the krcation where marijuana is being grown is listed as a medical marijuana growing site, m warrant should be sought, unless evidence errists of co~tx:t that would disqualify the person from the medical use of marijuana defense, or probable cause exists that another criminal offense has been or is being committed. On July 8, 2002, investigating officer Mark Ferias acted on a seazch warrant, which he obtained and' had it signed by Judge Florendo on Sunday, July 7, 2002. A warrant that should not have been sought. Hawaii tlm;n;ctrar;ve Rules, §23-202-11- Monitorin_o_ and rove ' ations. (a) The departmern may, at any time, contact a qualifying patient, primary caregiver, or attending physician by phone, mail, or in person to verify the current accuracy of information provided to the registration system (b) Notwithstanding subsection (a), the deparhnent may, when it has reason to believe a violation of the conditions of the registration exists, either conduct investigations to collect evidence of violations of Act 228, SLH 2000, Medical Use of Marijuana, or refer violation to the 'proper state or local authorities. Such violations iachule, but are not limited to the following: (1) A qualifying patiern fails to notify the department of any change in the patient's name, address, attending physician, designated caregiver, or growing location of marijuana to be used for medical purposes; (2) A qualifying patient or designated primary caregiver fails to return the registry identification certificate to the department within seven cakndaz days of notification of the diagnosis that the qualifying patient no longer has a debilitating medical condition; and (3) A qualifying patient, designated primary caregiver, or attending physician falsifies information during the registration or registration renewal process. There was not and is not any criminal activity going on here at my residence. Officer Ferias' performance of`duty was negligern in not performing his duties as required or directed by law, departmental procedures, policies, or orders of a command or supervisory officer according to Rules and Regulations recognized and signed by Acting Police Chief Lawrence K Mahuna on April 16, 2002. #3 -Obedience to Laws, Written Orders, Policies -Officers and employees of the department shall observe and obey all Federal and State Laws, Ordinances of the County of Hawaii, and all orders, policies, directives, regulations, etc., of the department. Officer Ferias has failed to recognize the ability for patients with State approved debilitating conditions to cuhivate medical cannabis for medical purposes. These Rules and Regulations drawn up by members of Hawaii County Police Departmetrt, implemented and recognized are for the protect~n of people like us, just because of his beliefs; it shouldn't hinder what our state has already enacted as Law. It was against our County Ordinance and Hawari County Police Department's Rules and Regulations, when officer Ferias acted and corninued to obtain the signature of a judge, even with the knowledge that our residence was a medical cannabis location. This was a direct disobedience of Hawaii County Police Department's Regulations on this investigation 2 ~ if4 -Commission of any Criminal Act -Officer and empkyees shall not commit any criminal act. (A) Damaging Private Property -Officers and employees shall not maliciously destroy or damage someone's private property without just cause. (B) Theft of Private Property -Officers and employees shall not take the private property of someone with the intent to permanently deprive the owner of said property. Officer Fazias had seized and destroyed under color of authority medical cannabis plants that were to be used to treat symptoms of a debilitating condition This medicine was mine, riot his to take and destiny. During this time officer Ferias had also ignored my NO TRESPASSING signs, which are posted throughout my property. This is a trespassing violation tY8 -Mistreatment of Person in Police Custody -Officers or employees shall not mistreat any person in police custody. Before piecing me in the DARE van to be taken against my will to the Kealakehe Police Station, I asked if I could change my attire, as the medical condition worsens in the void and having been to the Kealakehe Police Station before, it was fre+ezittg in the cell block units, in which he firmly said After begging and crying in front of my children and all present for him let the change, (I didn't even care ifan officer was present while 1 changed, it was more impnrt~t to get changed), officer Ferias finally let me do so. We'd been through this before, Detective Mitsuttaga and Detective Hec both laew that we arc trot high-risk people. Officer Ferias should have came fo our home with COMPASSION mt ATTITUDE and JUDGEMENT. ~ #12 - Tmpartial AtHtnde - Members of the department shall remaid'impartial to all persons coming to the attention of the department. They shall not exhibit partiality for or against any person Officer Ferias made mention during the process of booking us and basically says that "our past tells a story". This shows me he was judgmental right from the start, it would seem as though this was a quest to once and Sor all pin the Robison's away. This man doesn't know me. Along with all the above being mentioned, 1 want to also state that as soon as we got to the Kealakehe Police Station, officer Ferias was quick to memion that seizure and forfeiture of assets was a big thing for them, adding that he has another 12 years in this department. I chose to mention that because nowhere in this Complaint is a classificatmn of Retribution. Something an officer could easily be accused of just for being an officer of the law. Oa June 27, 2002, my husband and I had rcntrned to us by Hawaii County Police Department items that were confiscaked and rettuned to us from an asset seizure/forfeiture that took place in November of 2001. It is very interesting that Hawaii County Police Department would come and visit us exactly 11 days later. 3 i- Summary: HAR § 23-202-2 DeSnitions -Three mature, four immature mazijuana plants and one once of usable marijuana per each matured plant. ? Immature - means a marijuana plant whether male or female that has not yet flowered and which does not yet have buds that are readily observed by unaided V1SUa.1 examination. ? Mature - means a marijuana plant whether male or female that has flowered and which has buds that are readily observed by unaided visual examination. ? Usable Marijuana -Dried leaves and flowers of the plant Cannabis family Moraceae, and any mixture of preparations thereof, that is appropriate for the medical use of marijuana. "Usable" does not include the seeds, stalks and roots of the mazijuana plant. (Again in disobedience of the Law, I believe HCPD weighed the stalks and stems included with our dry confiscated and then returned medicine.) The Hawaii Medical Marijuana Act §329-125 -Any qualifying patient or primazy caze giver not complying with the permitted scope of the medical use of marijuana shall not be afforded the protections against searches and seizures pertaining to the misapplication of the medical use of marijuana. My household was in compliance with these rules and regulations, I personally feel that officer Farias acted beyond his capacity and authority and I believe that a numberpf rights and freedoms were violated. Violation of Article 1 Bill of Rights Section 6 -The right of the people to privacy is recognized and shall not be infringed without the showing of a state compelling interest. In which my case, there was none. Search and seizures and invasion of privacy. Article 1, Section 7 -The right of the people to be secure in their persons, houses, papers and effects against unreasonable searches, seizures and invasion of privacy shall not be violated; and no warrants shall issue but upon probable cause, supported by oath or affirmation, and particulazly desorbing the place to be searched and the persons or things to be seized or the communications sought to be intercepted. My right as a citizen to be secured in life, liberty and pursuit of happiness was violated. I was unlawfully arrested, unlawfully detained. Basically kidnapped and personal items stolen by our own Hawaii County Police Department personnel. These aze my basic rights that aze to be protected by you the Hawaii County Police Department. I will also note that on numerous occasions officer Farias made mention about what his true feelings were regazding medicinal marijuana and how he feels that someone like Kea would need it but questioned my husband and myself to the need as Kea was going through he 4 treatments right now, I believe he is an officer not a doctor. Also, I would like to mention to you some other comments officer Fazias made at the end of my interview. 1) That if we did have the plants labeled, he would have knocked on our door, verified that it was labeled and said "thank you very much for your time" 2) The writers of the law never intended for more than I person at one residence or location to have more than 7 plants at one location 3) My friend, Kea, would have to move because of #2. ,MISSION STATEMENT We, the men and women of the Hawaii County Police Department, are dedicated to creating a safe environment for the community through service, integrity, professionalism, respect and fairness. According to Hawaii County Police Department Interdepartment Rules of Conduct, General Order No. 300A, paragraph IV (F) -Knowledge of Laws, Orders, Po6eiea, etc. -Officers are expected to establish and ' maintain a working knowledge of those ordinances of the County of Hawaii, Statutes of the Stste of Hawaii, orders, policies, and directives of the department and divisions thereof which are applicable to their functions as police officers. Hickcox is responsible for the education and knowledge of his investigating officers and was responsible to protect my life, liberty and property according to the Hawaii County Police Department Mission Statement, from officer Ferias, who was under Lt. Hickcox's watch as Head of Vice Section Kona. Lt. Hickcox did not show PROFESSIONALISM in dealing with me to strive and maintain my confidence through professional performance and neither did he take every reasonable opportunity to maintain a high level of knowledge regarding medical mazijttana and the arrest he had come to make. Lt. Hickcox was to RESPECT me, treat me with kindness, I was working with him, and not at any time did he ask for us to take caze of our dog. He had told us to do so, which my husband was already in motion of doing as you will see per the videotape. 1 I would like to have my complaint reviewed in a meeting ~ open ? closed to the public. As seen on our videotape, Lt. Hickcox in an overbearing voice said to us, "take care of this dog or I going put him away". This was after I question officer Fazias on what statute we violated and he could not tell me. When I turned to see what Lt. Hickcox was making a commotion about, he was standing in front of my dog, who was on a cable chain attached to my house, wagging his tale at Lt. Hickcox and officer Kawauchi moments earlier, with a metal stake in his hand in a striking motion waiting to strike my dog. This to me was not only overbearing conduct but also a mistreatment of a member bf the public. This is a sweet dog who was and is tied up. Threatening to do harm and injury to my pet is like doing the same to a member of my household and that is uncalled for, you don't threaten to "put peoples dog down" over cannabis, especially if we have obtained the legal right to grow and use it. Summazy: Lt. Hickcox should be held accountable to actions ofthe officers under his command that day. There was adequate opportunity to call departments heads to clear up any misunderstanding that day, but Lt. Hickcox ultimately had made the decision as he permitted officer Fazias to continue to arrest and seize. That we just needed to be off the streets by 7:30 am, Monday morning, the public was so much in danger, even after we are legally entitled to grow and cultivate cannabis. I was unlawfully arrested, unlawfully detained. Basically kidnapped and personal items stolen by our own Hawaii County Police Department personnel. These are my basic rights that aze to be protected by you the Hawaii County Police Department. I will also note that on numerous occasions officer Farias made mention about what his true feelings were regarding medicinal marijuana was, along with stating that "it would be better if we all just grew them indoors, "out of sight, out mind". I feel that this whole situation could have been handled on a different ' level, being that we aze certified to cultivate and possess cauuabis. We have on many many occasions, offered for Detective Hee or even State Nazcotics Enforcement Division, Keith Kamita, to just let us know, we would be more than happy for them to come visit and investigate us, they didn't need to go through the whole process of wasting our taxpayers money to obtain a search warrant, get a judges signature and then come to my home with an entire task force and spend all that time filling out reports, documenting statements and seazch our private property for items we are legally entitled to have. A lot of this could have been avoided, even when during the course of the arrest my wife made mention for us to contact NED, Keith Kamita for clarification. Also, simply put, in our "rules to the certificate or the guidelines to the certificate", it does not - mention nor require that our cannabis be "definitively separated" or "that we cannot have more than 7 plants at one location", which accorc~ng to officer Fazias, Gvas the "the only problem". My household was in compliance with these rules and regulations, I personally feel that officer Ferias acted beyond his capacity and authority and I believe that a number of rights and freedoms were violated. Violation of Article 1 Bill of Rights Section 6 -The right of the people to privacy is recognized and shall not be infringed without the showing of a state compelling interest. In which my case, there was none. Search and seizures and invasion of privacy. Article 1, Section 7 -The right of the people to be secure in their persons, houses, papers and effects against unreasonable searches, seizures and invasion of privacy shall not be violated; and no warrants shall issue but upon probable cause, supported by oath or affirmation, and particubuly desorbing the place to be searohed and the persons or things to be sized or the communications sought to be intercepted. 4 #4 -Commission of any Criminal Act -Officer and employees shall not commit any criminal act. (A) Damaging Private Property -Officers and employees shall not maliciously destroy or damage someone's private property without just cause. (B) Theft of Private Property -Officers and employees shall not take the private property of someone with the intent to pem~anernly deprive the owner of said property. Officer Ferias had seized and destroyed under color of authority medical cannabis plants that were to be used to treat symptoms of a debilitating condition. This medicine was mine, not his to take and destroy. During this time officer Ferias had also ignored my NO TRESPASSING signs, which are posted throughout my property. This is a trespassing violation. #8 -Mistreatment of Person in Police Custody - In the (g) eight hours I was held against my will, I was denied my telephone call The reasons from officer Ferias were different all (3) three times. The fast was "you have to wait until the detective comes beck", the sewnd was "you should be out of here in about an hour or so" and the third time I requested to make my entitled telephone call I just never received a response. My wife and Kealoha both got to make telephone calls along with the "Ice offender" in the ceU right next to me. Officer Ferias sboukl have came to our how with COMPASSION v not ATTITUDE and JUDGEMENT. During the time we were being processed, it was so cold at the station, my friend; Kealoha let me use her sweatshirt as I began to shiver. Being that it was a women's sweater it didn't fit very well, it was too small. When officer Ferias came to give me an interview be asked if the sweater was mine and I said no and he said "yeah cause it doesn't fit me" and I told him that Kea had lent it to me. At this time I also stated to Mazk that I had pneumonia (3) three times before and cancer and that ifI got sick again I could possibly die, and that I didn't wad that. I would also hke to mention that I should have been able to access my medicine as prescribed to me by my doctor, which I was denied.
