Yesterday, New York City, Boston and Uganda (Africa) made enormous progress in protecting workers from tobacco
smoke pollution, while a federal appeals court dismissed a tobacco industry lawsutagainst the EPA's 1993 report on

A federal appeals court in Richmond yesterday dismissed a lawsuit filed by the tobacco industry that challenged the
U.S. government's 1993 finding that secondhand cigarette smoke is dangerous and may increase the risk of cancer.

Boston public health commissioners voted unanimously yesterday to ban smoking in bars, nightclubs, and restaurants,
making the city the largest on the East Coast to order virtually all workplaces to become tobacco -free.

Smokefree Uganda
The High Court has ordered the National Environment Management Authority (NEMA) to make a law that regulates
smoking in public places. Principal Judge Herbert Ntabgoba ruled that smoking violates the right of non-smokers to a
clean and healthy environment, contrary to Article 39 of the Constitution. He ordered NEMA to have the "smoking in
public places" law in a year. According to Phillip Karugaba of The Environmental Action Network (TEAN), NEMA
already has a draft law. "[T]he Principal Judge also declared that smoking in public places violates the right to life of
non-smokers, contrary to Article 22 of the Constitution," he said. According to Karugab a case filed by the anti -
