nttached fbr your I'avorablc consideration is Bill No. 39, Draft 4, which includes the following
amendments made at today's Council meeting:
1. Condition P. Offsets the improvements done in Condition R against the fair share
contributions in Condition P.
2. Condition R. Inserts language to state that the applicant will be responsible for
installing the 4-way stop condition at the Nani Kailua/Kakalina Street intersection
under the guidance of a licensed engineer within 90 days from the effective date
of the ordinance. Also inserts language to state that the licensed engineer will
consult the Kona Traffic Safety Committee and the Department of Public Works
regarding the impact of the improvement, and should they find that the 4-way stop
is not warranted. the applicant will restore the intersection to its original
condition.
