Dear Councilperson Elarionoff and Members of the County Council:
SUBJECT: Bill No. 280, Draft 3 -Sign Code
Please accept our apologies for our delayed response to Bill No. 280, Draft 3. For your
consideration, we offer the following comments:
Article 1
• Section 3-3 (Definitions) - A definition for directory signs is needed. For example, is
just one sign along front of property be considered a directory sign? Are sandwich
boards directory signs?
• Section 3-12 (signs permitted in RCX, V, CG, etc) - "wall sign" is defined as a type of
"marquee sign". However, a "wall sign" and a "marquee sign" are two different types of
signs and could potentially confuse the application of requirements for both signs.
Article 2 - Kailua Village Sims
• Section 3.61(a) "Vehicular access" is not defined in code. Would such a definition also
apply to interior driveways like those found at Lanihau Center? Applicability of code
should apply to signs along all vehicular or pedestrian ways, whether defined as a
roadway lot, access easement or driveway. Would the definition of "street" cover this? If
so, then the term "street" should replace the use of vehicular access within Draft 3.

• Section 3.61(a)(1) (ground sign) -Article 1 limits ground signs to one (1) per site. We
would rather see one ground sign permitted per street frontage, sort of like what one
would see at Coconut Grove Market Place, which fronts both Kuakini and Ali'i Drive.
Instead of an aggregate total sign area, specify maximum signage area to be permitted,
say 12 square feet in Kailua Village core and 22 square feet within the remainder of the
Kailua Village Special District.
• Section 3.61(a)(2)(B) (Marquee sign) -clarification that only one marquee sign upon the
face of a marquee. Marquee signs within the Kailua Village Special District should be
limited to no more than 22 square feet (or 12 square feet within Village core), similar to a
wall sign.
• Section 3.61(a)(3) (Projecting sign) - Article l states that projecting sign must be no
lower than 9 feet above public way. While silent within this section of Article 2, we
assume that the minimum height requirement specified within Article 1 will apply here as
well.
• Section 3.61(a)(4) (Wall sign) -second sentence in both (A) and (B) appears redundant
when compared with the first sentence, which speak of maximum permitted sign area.
• Provision within the sign code must be made to accommodate shopping complexes with
multiple tenants and the need for multiple signs. Section 3-63 does limit wall signs to
one per business or one for each street frontage. We question which requirement will
prevail for a shopping center that fronts a street. We would rather see that each business
be allowed a sign for each street frontage with a maximum area of 12 square feet if they
are located within amulti-business complex within the Kailua Village core and a
maximum sign area of 22 square feet if located outside of the village core.
• Section 3-63 (Number ofSigns) -Provision should be made to allow for select
combination of permitted signs instead of limiting the number of signs to one per
business. For example, we would have no problem with a tenant requesting both a wall
sign and a projecting sign, sort of like what one would find at Kona Coast Shopping
Center or Lanihau Shopping Center. Such complexes cater to both vehicular and
pedestrian traffic.

• Section 3-(4(a)(3) (Prohibited Signs) -Due to historical considerations, we recommend
that special provision be made to allow for the erection of a "temporary sign" or "banner"
over a vehicular right-of--way for only that portion of Palani Road in the immediate
vicinity of the King Kamehameha's Kona Beach Hotel, typical of the location used every
year for special events like the IronMan and the Kona Coffee Festival. Permitted banners
at this Palani Road location should be limited to special events advertising and erected in
a manner as proposed render Section 3-9 (Exempt signs). Note that Section 3-9(a)(1)(C)
[Exempt signs] also prohibit the display of temporary signs over a public right-of--way
and should be amended to accommodate this special consideration.
