HomeMy WebLinkAboutRES 048 Draft 01 2002-2004 COUNTY OF HAWAII STATE OF HAWAII RESOLUTION NO. 48 03 A RESOLUTION RELATING TO A COUNCIL INITIATED IMPROVEMENT DISTRICT TO FACILITATE CONSTRUCTION OF A TWENTY FOOT ROADWAY AND DRAINAGE IMPROVEMENTS OR A ROADWAY AND DRAINAGE IMPROVEMENTS BUILT TO CURRENT STANDARDS FOR CHONG STREET IN SOUTH HILO, COUNTY OF HAWAII, BY THE COUNTY DEPARTMENT OF PUBLIC WORKS. WHEREAS, Chong Street, aprivately-owned roadway, is located in TMK Nos. 2-5-14 and 2-5-15 (see attached Exhibits A-1 and A-2); and WHEREAS, over the years, some residents and owners of properties on and abutting Chong Street have expressed concern during periods of heavy rains because of intense flooding along portions of Chong Street; and WHEREAS, the landowner concern about Chong Street has not abated and the issues remain unresolved; and WHEREAS, on September 11, 2001, at a community meeting at Kaumana School, Council Member Bobby Jean Leithead-Todd and the Director of Public Works Dennis Lee listened and responded to community concerns about Chong Street; and WHEREAS, on November 25, 2002, Council Member Leithead-Todd and Director ofPublic Works Lee met with some concerned landowners in order to resolve some of the issues and it was determined that the initiation of an improvement district was desirable; and WHEREAS, an improvement district would benefit approximately forty-nine lot owners by facilitating the construction of either a twenty foot roadway with drainage infrastructure or a roadway and drainage infrastructure built to current standards, but would be paid for by these lot owners; and WHEREAS, pursuant to Chapter 12 of the Hawaii County Code, the Council may initiate an improvement district to improve roadway and drainage conditions; and WHEREAS, the first requirement of creating such a district is for the Director of Public Works to investigate various aspects of the project. NOW, THEREFORE, BE IT RESOLVEll BY THE COUNCIL OF THE COUNTY OF HAWAII that the Director of Public Works is hereby directed to prepare and submit to the Council a report fora 20-foot roadway with drainage infrastructure and a report for a roadway with drainage infrastructure built to current standards containing the following: (1) Preliminary data concerning the roadway and improvements proposed to be constructed; (2) The general character and extent of any improvement to be proposed; (3) 'The proposed assessment unit and method of assessment. (4) Whether any new land will be necessary to be acquired, and the estimated cost thereof, and the proportion of the cost which should by borne by the County; (5) T'he materials recommended to meet conditions of improvement; (6) The boundaries of the proposed improvement district and any subdistricts and zones therein as to which different portions of the costs of improvements should be charged; (7) The estimated cost of the improvement, the portions of the cost to be borne by the Cowrty, and the portions of the costs to be against the assessment units lands specially benefited with the maximum unit of assessment to be made against each assessment unit to be assessed. (8) All necessary plans and other data, detai]s, and specifications for the improvements and other matter or details intended to apply thereto. BE IT FINALLY RESOLVED that the County Clerk is hereby directed to furnish copies of this resolution to Mayor Harry Kim, and Director of Public Works Bruce McClure.
