RESOLUTION NO. 51 03
RESOLUTION CREATING A DEPUTY CORPORATION COUNSEL POSITION FOR
THE OFFICE OF THE CORPORATION COUNSEL
WHEREAS, there has been an increased demand for legal services by the County
Departments and Agencies; and
WHEREAS, specialization is becoming the standard in the practice of law and in order to
properly and effectively represent the County, it is necessary for the attorneys to develop expertise in
specific areas of the law; and
WHEREAS, the present staffing limitations does not allow the attorneys of the Corporation
Counsel the necessary time to develop this expertise; and
WHEREAS, aside from the daily legal demands placed upon the attorneys, they are trying to
develop a comprehensive risk management program to protect the County's interests; and
WHEREAS, creating a new Deputy Corporation Counsel position will allow the Office of the
Corporation Counsel to maintain a more "pro-active" legal presence in the County and to allow the
attorneys the opportunity to develop expertise in specific areas of the law, and
WHEREAS, the Department of Water Supply has indicated they are desirous of funding this
attorney position within the Office of the Corporation Counsel; and
WHEREAS, the Department of Water Supply has indicated they believe it is fair and in the
collective best interest of the County that they provide funding for this attorney position, since as a
semi-autonomous department within the County, they do not contribute to general fund revenues, but
are receiving the benefits of legal representation by the Office of the Corporation Counsel; and
WI-t~~~~S, Article V, Section 5-1.3(c) of the Hawaii County Charter states that the Mayor has
the power to "Create positions...forwhieh appropriations have been made by the council...".
