RESOLUTION NO. 53 03
A RESOLUTION AUTHORIZING THE TEMPORARY BARRICADING OF STUB-OUTS
ON LAKO AND KINAU STREETS IN KAILUA-KONA, AS PERMITTED UNDER
CHAPTER 24 OF THE HAWAI`1 COUNTY CODE 1983 (1995 EDITION).
WHEREAS, Lako and Kinau Streets are county-owned public roads that traverse the
subdivision known as Kona Vistas in Kailua-Kona; and
WHEREAS. Lako and Kinau streets were constructed with stub-outs to facilitate possible
further development in the area; and
WHEREAS, residents near Lako and Kinau Streets have reported that illicit activities such as
loitering, littering, drinking and drug use are occurring along stub-outs located on both of these
streets; and
WHEREAS, to curb these activities, the Hawaii County Police Department is requesting to
temporarily barricade these stub-outs (Exhibit A); and
WHEREAS, the proposed barricades will not affect the flow of traffic or impede public
access; and
WHEREAS, the Hawaii County Police Department has consulted with the Department of
Public Works. Traffic Division and provided adjacent landowners with written notification about the
proposed barricades (Exhibit B); and
WHEREAS, adjacent landowners are in support of temporarily barricading the stub-outs
located on Lako and Kinau Streets (Exhibit C); and
WHEREAS, barricading the stub-outs will be a cooperative effort between the Hawaii
County Police Department and the Department of Public Works, "traffic Division; and
WI~IEREAS, Chapte?= 2~, 4rticle 7, Division 3, Section 24-153.3 of the Hawaii County Code
l 983 (1995 Edition) allows for the Council to authorize the temporary closure of stub-outs to
prevent loitering, littering and other illegal activities as long as the closure does not affect the flow of
traffic or public access and adjacent landowners are provided with written notification by the
requesting agency before closure.
NOW, TI-IEREFORF, I3E IT RESOLVED I3Y THE COUNCIh OF THE COUNTY OF
HAWAII that, pursuant to Chapter 24, Section 153.3 of the Hawaii County Code, it authorizes the
installation of temporary ba~•ricades at the stub-outs located on the terminus of Lako and Kinau
Streets within the Kona Vistas Subdivision (Exhibit A).
SE IT Ft1RTHER RESOLVED that the Clerk of the County of Hawaii is hereby instructed
to transmit copies of this resolution to Officer Steven Chung-I-Ioon, Hawaii County Police
Department and the Department of Public Works, Traffic Division, upon approval.

Attention residents/Landowners of Kona Vistas;
This notice is to inform you that the County is considering the
barricading of Kinau St. stub out and the Lako St. dead end at the top of Lako
Street. This is being done to subside any loitering, littering and other illegal
activities that have reportedly been occurring in these areas. A left turn onto
Kinau Street from Lako Street will still be available.
Any questions can be directed to Officer Steven CHUNG-HOON of the Hawaii
County Police Department's Community Policing Unit in Kona at 326-4222.

Dear Chief Correa,
As homeowners in the Kona Vistas subdivision, we have grave concerns about a variety of
illegal activities occurring at the termination ofLako Street in our subdivision. We brought these
concerns to the Traffic Safety Committee at its recent rueeting on January 23. It was suggested
that you could help by allowing installation of temporary cement barricades across two road
stubs that wilt eventually be extensions of Kinau and Lako Streets. During the time we have
lived here, these road stubs have been providing an all-too-convenient parking place for people
from outside the neighborhood to commit vazious crimes and nuisances. The following activities
have been occurring there during broad daylight, but predominantly at night:
Drug dealing
Public urination
Littering and dumping of household garbage and yard debris
Loitering (including sleeping in cazs overnight)
Loud parties, particularly by underage drinkers
Graffiti on rocks, public signs, light poles, and public utilities in and near the intersection
Smoking marijuana
Theft of neighborhood pets
Theft of and damage to stop signs, `TIo Parking" and "No Littering" signs
Illegal fireworks which have ranseA at least one hmsh fire adjacent to homes
We call the police to intervene when we observe these problems, but are frequently told by the
police dispatcher that no one is available to respond because the on-duty police ate already
occupied by higher-priority situations in the cotrwtutvty. We definitely need more police
coverage in Kona, but even that would be art incomplete solution to out problem, because the
police can't be in out neighborhood 24 hours s day while these problems continue to occur. For
safety reasons, residents have been discouraged by members of our police force from confronting
the people who are causing the problems. Therefore, we have little recourse in solving these
problems except through the traffic commission, and now, hopefully, through your office.
We request that the powers of your office direct the eounry to erect cement barricades to block
the two road stubs at this termination of Lako Street so that people cannot pull off the street and
park there. There used to be "No Parking" signs posted around the top of this intersection, but
they have been stolen or painted over. This intersection has already been designated by the
Comm. No.

county as a no pazking area. Therefore, we see no reason why these road stubs should not be
barricaded until Gaparex (the developer) is ready to build Phasc 2 of Kons Vistas.
Those of us signing this letter are homeowners who were able to attend the last Traffic Safety
Committee meeting. However, dozens of other Kona Vistas households are affected by these
circumstances, and we write to you on behalf of all. Thank you for your attention to our
concerns and your efforts in helping us solve this on-going problem in our neighborhood.
