This is to acknowledge receipt of your annual report on March 27,
1997 for the above-referenced Change of Zone Ordinance No. 94-78,
Special Permit No. 863 and Use Permit No. 74. Thank you for
complying with this requirement.
We shall accept this letter as meeting full satisfaction of the
annual report requirements for all of the above approvals. All
future annual reports may be submitted in one letter with a
detailed discussion of applicable conditions within the specific
permit or ordinance.
We will forward your report to the Planning Commission and County
Council for their review.
Based on the different anniversary dates for each of the
approvals, we shall use the effective date of the change of zone
ordinance as the due date. Therefore, your next annual report
for the subject ordinance and permits shall be on or before July
13, 1998.

RE: Annual Report Requirement
Big Island Country Club Estates
Tax Mao Key: 7-1-5: Various
There were several pertinent approvals that required the
submittal of an annual report. These were a) Use Permit No.
74, which was approved on March 1, 1990 to allow the
establishment of a 27-hole golf course and related
improvements; b) Special Perntit No. 93-24, which was approved
on February 17, 1994, for the expanded use of the golf
clubhouse and community facilities; and c) Ordinance No. 94
78, which became effective on July 13, 1994. Because they
all relate to the same project, we respectfully request your
continued acceptance of this letter in full satisfaction of
the annual report requirements for all of the above
approvals. A similar report was submitted last year in
March.
As this project is an ongoing one with considerable
progress made since the permits were issued, this report will
be an update of last year's report; and if you desire
additional information or have questions on other related
matters, please let me know.
USE PERMIT No. 74
Construction commenced on February 26, 1993. The
grading and shaping work for the first eighteen (18) holes
have been completed. Grassing and maintenance are the
primary activities for that area now. The anticipated
opening of this course would be early 1997.
Work for the remaining nine (9) holes will begin within
the next few months. The archaeological condition relative to
discovery of sites will continue for this phase. Likewise,
the suggested mitigations reflected in the approved floral
and faunal mitigation programs as well as the dust mitigation

programs will continue to be implemented in this phase.
The applicant will shortly be submitting its overall
program to satisfy the recreational benefits program outlined
in this Permit, as well as the rezoning condition. Likewise,
the channelized intersection and the interior roadway to the
clubhouse will be completed before the end of this year. It
is understood that these must be fulfilled before the golf
course is opened.
In the area of water, the potable wells are already in
place. The required certification of the water wells from
the State Department of Health are now being worked on.
Further, the formation of a private water company and the
required approvals from the Public Utilities Commission are
now being worked on.

This permit relates to the expanded use of the clubhouse
and the community park.
The building permit for the clubhouse has been issued
and construction has already begun. It is anticipated that
the clubhouse should be completed before the end of this year
or early 1998. Likewise, plans for the maintenance building
are now being finalized, and permits will be applied for
within the next month.
Plans for the volunteer fire station and the community
recreation are now being prepared. Construction of these
facilities will be completed prior to opening of the golf
course. At this time, the tentative opening date is late
1997 or early 1998.
During construction of the clubhouse and community
facilities, the applicant is aware of and will comply with
the appropriate archaeological and dust control conditions.

This relates to the rezoning of the project site.

proof that water is available to service the site.
Since that time, preliminary subdivision approval has
already been secured. The applicant is now in the process of
complying with the appropriate subdivision conditions, some
of which are related to rezoning conditions.
In that regard, construction plans for the interior
roadways are now being prepared. Provisions for water to the
community park and adjoining properties are being made as
part of the construction plans.
As noted earlier, the required certification of the
wells from the Department of Health and formation of a water
company are already underway. In the preparation of the
final plat maps, appropriate easements to reflect the
requirements of the State relative to access to the north and
makai area, as well as burial site access will be prepared.
Then, too, we will be working with your office in trying
to satisfy the impact fee requirements. Proposed covenants
relative to no ohana, agricultural restrictions, and other
matters will be submitted to your office for approval. It is
understood that these, among other conditions, must be
satisfied before final approval can be secured.
On a related matter, the Special Permit for the 50-unit,
members only lodge is now under appeal with the Circuit
Court. It is hoped that a decision on this matter could
occur within the next few months.
