STUB OUTS ON LAKO AND KINAU STREETS IN KAILUA-KONA. AS
PERMITTED UNDER CHAPTER 24 OF THE HAWAII COUNTY CODE
1983 (1995 EDITION).
Dear Joe:
Thank you for faxing me a copy of the draft resolution regarding barricading of the
roadway stub -outs at Kina'u and Lako Streets within Unit I of Kona Vistas subdivision.
Gamrex. Inc. owns the lots located on the northeast, southeast, and southwest corners of said
intersection. The proposed barricading plan is shown on Exhibit "A" attached hereto prepared
by Officer Steven Chung Hoon of the Kona Police Department. Enclosed herewith as Exhibit
"B" is a map of the intersection for your reference. It shows the location of the three (3) Gamrex
owned lots and lot 1 B/40 located on the northwest corner of the subject intersection. 1 spoke
with the lot owner (Mr. Bo Whittenton) of Lot 1 B/40 yesterday and gave him a copy Exhibit "A"
for his review and comment.
Late last year I sent a letter to Bobby Jean Leithead-Todd regarding the proposed
barricading. Enclosed herewith is a copy of that letter. Gamrex concerns remain unchanged and
are clearly stated in my October 28, 2002 letter. Gamrex concerns in "I." Regarding a 20 foot
wide opening centered in the Lako and Kina'u Street barriers for construction access into Unit 2
are shown on Exhibit "A" but no detail is shown on the chain and supporting pipe therefore. 1
assume that my comments on security and keys for any locks placed on the chain are acceptable
to HPD and the Council. Gamrex concerns stated in ..2.". " 3." and -4.- remain unchanged. I see
no "hold harmless" clause from the County for liability in connection with the subject barricades
for Gamrex (specifically) in the draft as set forth in "5." in my October 28. 2002 letter. Gamrex

I have several comments and concerns on the actions proposed in the subject draft
resolution. The proposed barricading plan is designed to force cars to park illegally in front of
the barricades on both Lako and Kina'u Streets that facilitates police enforcement in the area. It
should also be noted that Lako Street has a 14% grade in and around the subject intersection.
This leads to a safety concern for a negatively impacted Kona Vistas lot owner.
Please refer to Exhibit 'B" showing Lot 40 located just below and on the comer of the
Lako Street Barricade owned by Mr. Bo Whittenton. Recently an illegally parked vehicle in the
subject intersection rolled down and onto Lot 40. Enclosed herewith as Exhibit "C" are pictures
of the accident. Mr. Whittenton asked the County on July 10, 2002 to install a guardrail at the
corner of his lot to prevent this from happening again. A copy of his July 10, 2002 letter is
attached. His request was denied as shown on the attached letter dated July 23, 2002, from
DPW. Mr. Whittenton presently is building a home on the lot.
The proposed barricading will force cars to park on Lako Street facing Lot 40. The
crowning and natural grade of Lako Street will send all run -away vehicles down onto Mr.
Whittenton's lot and future home. The proposed barricading plan concentrates illegal parking
opportunities on Lako Street above Mr. Whittenton's lot and the County therefore should
logically provide protection to Lot 40 by means of a guardrail. This occurred recently and
should it occur during the barricading period it could lead to tragic consequences. Mr.
Whittenton has submitted a fairly detailed proposed guardrail plan for the subject intersection
attached hereto as Exhibit "D" that shows road elevations and a site plan of his home under
construction. Should this occur again, the car will fall onto his home. Gamrex is concerned as it
is indirectly part of the proposed barricading plan and asks the Council to seriously consider Mr.
Whittenton's guardrail request as liability insurance.

Dear Council Member Leithead-Todd:
The County Council recently passed an Ordinance allowing the Police Department to
barricade roadway stub -outs in subdivisions to curtail illegal activities.
I was contacted last week by Officer Chung -Hoon of the Kona Police Department stating
they would be initiating the barricading of County owned roadway stubs on Kina'u and Lako
Streets within Kona Vistas Subdivision soon.
I informed Officer Chung -Hoon that Gamrex, Inc.,owner/developer of Kona Vistas
Subdivision, has no objection to the barricading as long as the following items can be met due
to the fact that Gamrex, Inc. will begin construction of roadways within Unit 2 of Kona Vistas in
the near future.
A twenty foot (20°) wide opening is centered between the barricades secured by a
chain with a post to support it on both roadways. Gamrex, Inc. would place its own
lock on the chains in order to access its land South and East of the barricades. I am
assuming that the police department will have its own lock and key that will be made
available to emergency vehicles. Gamrex`s key can be obtained that the Kona
Vistas Sales Office daily between 10:00am to 5:00pm. Any after hour emergencies
will require the key held by the Police Department.
2. Gamrex, Inc. will be constructing roadways within Unit 2 of Kona Vistas in the near
future and it requires construction access through both Kina'u and Lako Streets.
Should placement of the barricades impede construction vehicles, Gamrex will
request their removal. You will recall Council Member Tyler's question to me at the
last Planning Committee Meeting regarding the Lako Street connection. This
construction will be accessed via both subject roadways. Should their removal be
required, they will be removed at County expense.
3. Any damages to County roadways caused by the placement and/or removal of the
twenty foot long concrete barricades will be repaired at County expense.

4. Gamrex, Inc. will be allowed to post "No Trespassing" signs on the barricades and/or
chains. A copy of the sign is attached hereto.
5. Gamrex, Inc. shall be held harmless by the County from any liability in connection
with the subject barricades as certain portions of these will be positioned on Gamrex
owned lands.
6. Upon completion of Unit 2 roadways, all streets will be dedicated to the County of
Hawaii. At that time, the Kina'u/lako Street intersection will be a four way County
owned intersection that will not need barricading.

I would like to express my concerns for the need of a steel guard rail on rhe
North side of Lakc street in Kona Vistas. The elevation on the corner of Kina'u
and Lake street is 519 ft. and rrp proposed slab elevation is to be at 506 ft.

I plan to build a house by end of this summer and this -ar would of ccr..e
through the ed5a of my roof and into the back of my garage.
When you ocEn up Lakc street to more traffic, then the risk increases and
Easter moving car Joule come further into my house and xill scmecne.
Please consider putting a steel guard rail for our safety.

Thank you for your request dated July 10. 2002. %Ve are aware of the accident you
described. As discussed previously with our staff. guardrails are required in new construction
when warranted. "fo meet the warrants, the drop off should be within a designated -clear i.one.
Che clear zone is an area provided for an errant driver to recover hascd on nationalh_ rccoUgnized
standards.
Guardrails are gencralh installed to protect drivers from roadside hazards, rather than
protecting private property. In the case you described_ no-one was operating the ychicic and the
drop off is outside the standard clear zone of 16.5 feet. VVe have determined that expcnclitures rel
County funds in the subject case is not warranted.
As related by our staff, you may wish to install a barrier to protect your property
Structures exceeding 3 lect in height must oomph with the 3 loot 111AXi num height at the corner
radius so that intersection sight distance is not obstructed. Otherwise. a building permit is
required for structures exceeding 6 feet in height.
