HomeMy WebLinkAboutRES 059 Draft 01 2002-2004 COUNTY OF HAWAII STATE OF HAWAII RESOLUTION NO. 59 03 RESOLUTION AUTHORIZING THE DIRECTOR OF FINANCE TO QUITCLAIM A PORTION OF THE COUNTY'S INTEREST, AND TO GRANT ARIGHT-OF-ENTRY TO A PORTION OF KULA`IMANO HOMESTEAD ROAD, IDENTIFIED AS PARCEL lA, CONTAINING AN AREA OF APPROXIMATELY 617 SQUARE FEET, BETWEEN TAX MAP KEYS:(3)2-8-016 AND 2-8-020, TO THE STATE OF HAWAI'l. WHEREAS, the State of }{awai`i, Department of Transportation, requires a portion of the Kula`imano Homestead Road, situated at Kula`imano and Pepe`ekeo, South Hilo, County of Hawaii, State of Hawaii, in connection with the proposed highway project No. HWY-H-07-00 (hereinafter "highway project"); and WHEREAS, Kula`imano Homestead Road is owned by the County o f Hawaii; and WHEREAS, pursuant to Hawaii Revised Statutes Section 264-2, if a County highway is required by the State for State highway purposes, the ownership of the County highway shall be transferred to and vested in the State without compensation; and WHEREAS, the highway project consists of widening the Hawaii Belt Road/Kula`imano Road intersection, which will provide left-turn lanes for traffic turning into North and South Kula`imano Road, the installation of additional street lights, and providing adequate sight distance for vehicles exiting North Kula`imano Road; and WHEREAS, in order that the highway project may proceed without delay, aRight-of--Entry to Parcel lA, pending the execution of the Quitclaim Deed conveying the parcel to the State is required; and WHEREAS, Hawaii County Charter Section 13-21 requires County agencies, in the performance of their functions, to cooperate with State government agencies having similar functions, and the County of Hawaii Director of Public Works recommends approval of the subject highway project; and WHEREAS, pursuant to Ilawai`i Revised Statutes Section 46-8, the County Council may enter into agreements with the State government for the co-sponsorship and joint development and maintenance of programs and projects, within and for the County, which have been authorized by the Legislature or for which moneys have been appropriated by the Legislature. NOW, THEREFORE, I3E IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII, in accordance with Hawaii Revised Statutes Section 46-8, that the Director of Finance of the County of Hawaii is authorized to execute, on behalf of the County, the Quitclaim Deed and Right-of--Entry Agreement in substantially the form attached hereto and incorporated by reference herein as Exhibit "A" to enable the State to proceed with the highway project described herein.
