Box 4849 Hilo, HI 96720 RE: Kulaloa Community Association -Gate Installation across Kulaloa Road Easement Area (Land Office Deed No. S-2?680) Deaz Mr. Giffin: The Directors of Kulaloa Subdivision aze requesting that they be allowed to install a gate across the road easement azea at the entrance to their subdivision. Please try to understand their frustration that has lead to their request. On a daily basis, during the day and evenings, Kulaloa residents see individuals who have no business being there driving through the subdivision dumping rubbish along the way. Residents have called the police on numerous occasions, but the police response time is on an average of two hours. There have also been robberies during the day while residents are at work. Since Kulaloa Road is private, the association is responsible for maintaining its condition as well as the shoulders alongside it. There aze now signs of cars driving on the shoulders, causing ruts in the grass that make it difficult for the association to mow. The residents aze aware that hunters may hunt 1/2 hour before and after sunset. Since the Department of Land and Natural Resources (DLNR) is not policing the situation, there are hunters at all hours of the evening accessing the Waiakea Forest Reserve. Residents report that they hear gun shots being fired every so often during the evenings in the forest. On one occasion, a resident disposed of a pig's head that was left on the road near the entrance to the forest reserve. At the very top of the road, unwanted visitors leave condoms, needles, broken beer bottles, and trash which are cleaned up by the Kulaloa residents. Based on DOFAW's review and recommendation on this matter, we are denying Kulaloa Community Association's request to amend the subject Grant of Easement (Land Office Deed No. 5-27680) in order to allow for the installation of a gate across the Kulaloa Road easement area. After considering all of the issues involved in this matter, the Department of Land and Natural Resources feels that public access to the Waiakea Forest Reserve should not be restricted or impeded in any form or manner. In the Grant of Easement, Article 17 tcopy inclosed) states, "No gates, barttcades or the like shall be erected across the easement area.... " For many years hummers have bein parlang on the vacant lots illegally, ruining the common area frontage of individaal lots, to eater the State Forest Reserve which boarders the Kuhrloa Community Association. It is not only the hunters that aze disturbing the residinis, but there are also a lot ofteenagers who drive to the top of the culdesac to drink & party. Ahhough the residems in the irrunediate area have let the trespassers Imow that they aze disturbing them, dre parry goers aze now taking their vehicles into the State Forest Reserve. By doing so, they are endangering themselves and putting fire State in a very vulnerable position if an accident were to occur. The Board feels that Article 17 puts the public's needs ahead of the private owners. They are not protesting the public's access, they would just hire to have a gate erected across the easemect with only residents of fire subdivision having vehicle access. The public's access would not be prohibited, just the vehicles. A pedestrian gate way would be provided to the public. Please take our request into great consideration.
