RE: Pauka'a Sewer Project
Dear Councilmember Yagong:
Thank you for the opportunity to discuss this important County wide matter with you and Mr.
Johnston, the President of the Pauka'a Community Association. You requested that I send you this
letter regarding the County's position concerning the proposed condemnation action. As I mentioned,
our office has always been willing to negotiate the condemnation price for each individual landowner.
Once the County Council authorizes our office to proceed with the condemnation action, we will
negotiate a settlement price with each landowner. I anticipate that the attorney assigned to this case
will meet, discuss and negotiate a settlement with each individual landowner. As I also mentioned, the
final negotiated settlement or amount may not be the full amount that the landowners and you have
requested from our office. However, we view the current appraisal as a starting point for further
negotiations.
You have also expressed an interest in participating and approving any settlement in this matter. 1
encourage you to amend the existing resolution to require our office to present any settlement offer to
you and the full Council for review and approval, as our office does with any case requiring a cash
settlement. [understand that you want to directly participate in negotiations on the landowners' behalf
and our office will make every effort to keep you advised of any negotiations and offers of settlement.
You also have an open invitation to participate in any negotiations on behalf of the residents. I need to
note that any settlement will be a matter of public record once approved.

questions or concerns.
