Brilhante Self-Directed IRA Request: RS-10 to CG-20 Tax Ma~Key~ 2-2-024:012 The Planning Commission, after a duly held public hearing on February 21, 2003, voted to recommend for your approval the proposed legislative bill to change the district classification for approximately 23,761 square feet of land from Single Family Residential (RS-10) to General Commercial (CG-20). The property is located in Waiakea House Lots 2°d Series, on the west side of Kilauea Street, adjacent and south of YWCA Office (former Ha]'s Radio & TV Service), WaiSkea, South Hilo, Hawaii. The Commission concurs with the following Planning Director's reasons for recommending favorable consideration of the change of zone: First Hawaiian Bank, Trustee of the William V. Brilhante Self-Directed IRA, is requesting a change of zone from Single Family Residential (RS-10) to General Commercial (CG-10) for approximately 23,761 square feet of land. The applicant proposes to demolish the existing dwelling and construct an approximately 8,000 square foot one-story office building to accommodate about 10 tenants. The applicant has been approached by prospective tenants who are interested in office-type uses. According to the applicant, the approval of this request would allow for greater flexibility to accommodate commercial uses and respond to community and market demands more readily. Arakaki, Chairman and Members of the County Council Page 2 In order to consider an area for any type of zoning designation, the applicable goals, policies and standards of the General Plan must be adequately addressed. It is only through such a comprehensive policy analysis approach that evaluations and decisions can be made to better time and stage developments to achieve growth determined by the General Plan and related planning documents. The implications of these evaluations and decisions must also be considered as they may have an impact on similar areas in the County. The Change of Zone request from a Single Family Residential (RS-10) to General-Cormercial (CG-10) zoned district will conform to the following goals, policies and standards of the General Plan Land Use and Economic Elements. Land use is one of the principal focal points of public concern and policy. The Land Use Element provides the primary basis for direct control and guidance of publicly and privately owned resources. It is also intended to be used as a policy guide for the coordinated growth and development of all sectors of the County. It sets forth goals, policies, standards and courses of action to accommodate growth without congestion, to designate and preserve the lands needed for residential use, commercial and visitor services, industry, agriculture and open space, and to coordinate these uses with the County's service and circulation systems. The overall Land Use goals, policies and standards are set forth to physically plan the lands in the County in the best interest of the island's residents. These state the following for the Land Use and Commercial Elements: LAND USE -GENERAL • Designate and allocate land uses in appropriate proportions and mix and in keeping with the social, cultural and physical environments of the County. • Zone urban- and rural-types of uses in areas with ease of access to community services and employment centers and with adequate public utilities and facilities. • Allocate appropriate requested zoning in accordance with the existing or projected needs of neighborhood, community, region acrd County. • The County shall encourage the development and maintenance of communities meeting the needs of its residents in balance with the physical and social environment. • Zoning requests shall be reviewed with respect to General Plan designation, district goals, regional plans, State Land Use District, compatibility with Honorable James Y. Arakaki, Chairman and Members of the County Council Page 3 adjacent zoned uses, availability of public services and utilities, access, and public need. LAND USE -COMMERCIAL • Provide for commercial developments that maximize convenience to users. • Provide commercial developments that complement the overall pattern of transportation and land usage within the island's regions, communities, and neighborhoods. • Commercial facilities shall be developed in areas adequately served by necessary services such as water, utilities, sewers, and transportation systems. Should such services not be available, the development of more intensive uses should be in concert with a localized program of public and private capital improvements to meet the expected increased needs. • Distribution of commercial areas shall be such as to best meet the demands of neighborhood, community and regional needs. • The development of commercial facilities should be designed to fit into the locale with minimal intrusion while providing the desired services. Appropriate infrastructure and design concerns shall be incorporated into the review of such developments. • Commercial development shall be located in areas adequately served by transportation, utilities, and other amenities. Commercial developments shall provide for adequate internal circulation amongst commercial facilities in the area. The proposed change of zone request would further the County's goals of providing an economic environment which allows new or existing businesses to expand and diversify the County's economic base, and thereby also increase the choice of occupations. The proposed zone request would be consistent with the following goals and policies of the Economic Element. • Provide residents with opportunities to improve their quality of life. • Economic development and improvement shall be in balance with the physical and social environments of the island of Hawaii. Arakaki, Chairman and Members of the County Council Page 4 • The County of Hawaii shall strive for diversity and stability in its economic system. • The County shall provide an economic environment which allows new, expanded, or improved economic opportunities that are compatible with the County's natural and social environment. • The County shall strive for an economic climate which provides its residents an opportunity for choice of occupation. • The County shall strive for diversification of its economy by strengthening existing industries and attracting new endeavors. Also, in the General Plan, a Course of Action for commercial development within the South Hilo District recommends that "Appropriately located commercial zoned lands shall be allocated as the need arises." This request would be consistent with the urban form depicted for Hilo in [hat it would add commercial uses serving the surrounding area as well as the Hilo community. In addition, this area of the Waiakea House Lots is in transition from residential to commercial uses. The Land Use Pattern Allocation Guide (LUPAG) Map component of the General Plan is a representation of the document's goals, policies, standards and courses of action to guide the coordinated growth and development of the County. It reflects a graphic depiction of the spatial relationships among various land uses and the expressed policy statements of the document itself. The LUPAG Map establishes the basic land use pattern for areas within the County. It is only through such a comprehensive policy analysis approach that evaluations and decisions can be made to better time or stage certain developments to achieve growth determined by the General Plan and related planning documents. The implications of these evaluations and decisions must be also considered as they may have an impact on similar areas in the County, but ultimately, on the future development of the whole island. As part of the General Plan comprehensive review in 1989, the High Density Urban designation, from Medium Density Urban, was expanded from Mohouli Street to Lanikaula Street. This designation allows for commercial, multiple residential and related services (general and office commercial; multiple residential - up to 87 units per acre). The State Land Use designation for the subject property is Urban. The Hilo Community Development Plan (CDP), adopted through Resolution No. l by the Planning Commission in 1975, is intended to provide short and middle range implementation strategies for the goals, policies and land use pattern presented in the Honorable James Y. Arakaki, Chairman and Members of the County Council Page 5 General Plan. The Hilo CDP reflects this section of Waiakea House Lots for residential uses. However, the Hilo CDP has not been updated to be consistent with the General Plan and complement the ongoing transition to commercial uses. Surrounding lands are zoned Single Family Residential (RS-10) and General Commercial (CG-20). Adjacent and to the west of the property are single family residences. Adjacent and to the north is the YWCA's Healthy Start Program (previously Hal's Radio and TV Service) and to the south is Kilauea Plaza, primarily an office building. Beyond Kilauea Plaza is the Kilauea Kitchen Restaurant and Hilo-Shi Bento Ya & Bakery, Tykes Laundromat and Personal Touch Dry Cleaning. The property across of Kilauea Avenue is the Church of Jesus Christ of Latter-Day Saints. The subject property is also about a block southwest from the Hilo Shopping Center complex, where there are existing commercial activities. The Hilo Shopping Center complex was developed in the early 1960s. From 1967 to present, numerous parcels in this section of Waiakea House Lots have been rezoned from Single Family Residential (RS-10) to Commercial Office (CO), General Commercial (CG) or Neighborhood Commercial (CN). Those rezoning extend from Mohouli Street to Lanikaula Street and Kilauea Avenue to Kino`ole Street. The various uses on those parcels include real estate and attorney offices, financial institutions, doctor and medical offices, laundry cleaning facility, restaurants, government office, and other office type of uses. Therefore, the requested CG zoning would be consistent with the existing land use pattern established within this portion of Hilo. In addition, the establishment of office uses would complement the existing surrounding uses. To mitigate any possible visual or noise impacts that the proposed use would have on adjacent residential properties, a condition of approval is included for the applicant to provide appropriate landscaping along the entire west property boundary. Also, the applicant would be required to comply with the Planning Department's Rule No. 17 regarding landscaping. Therefore, a favorable recommendation of this change of zone request to CG-10 would be appropriate. The property is located within an area adequately served with essential services and facilities such as water, sewer, transportation systems and other utilities. The access to the property is from Kilauea Avenue, which is County maintained with a 44-foot wide fully improved pavement within a 60-foot right-of-way and includes curbs, gutters and sidewalks along both sides of Kilauea Avemie. According to the City of Hilo Zone Map, Kilauea Avenue is proposed to be widened to an 80-foot right- of-way. Therefore, a 10-foot road widening strip along the frontage will impact the Honorable James Y. Arakaki, Chairman and Members of the County Council Page 6 property. A condition of approval will be included that the 10-foot road widening be delineated on the site plan for Final Plan Approval. No on-street parking is allowed along this section of Kilauea Avenue. According to the Department of Water Supply, the parcel is currently serviced by a 1-inch service lateral with a 5/8-inch meter, restricted to daily maximum 600 gallons. Water can be made available from an existing 10-inch waterline along Kilauea Avenue, with a meter connection size subject to review and approval during the construction design phase of the proposed development. Further, an anticipated maximum daily water usage and water commitment deposit will be required. The applicant has indicated that it will connect to the existing County sewer lateral within Kilauea Avenue. Conditions of approval are included to reaffirm the water and sewer system requirements. Police services are available from the main station on Kapiolani Street. Fire services are available from the Hilo Central Station at the corner of Kino`ole Street and Ponahawai Street. All other essential utilities and services are available to the property. The project has no severe geological or topographical problem which cannot be properly rectified or which would render the land unusable. The property is classified as Flood Zone X, areas determined to be outside the 500-year flood plain, on the Flood Insurance Rate Map (FIRM) prepared by the Federal Emergency Management Agency (FEMA). The subject request is not contrary to Chapter 205A, Hawaii Revised Statutes, relating to Coastal Zone Management Area. The property is not situated within the Special Management Area. I[ is located approximately three miles from the nearest coastline and outside of the tsunami inundation area. Therefore, the proposed development will not be impacted by coastal hazard and beach erosion. There is no identified recreational resources, historic resources, public access to the shoreline or mountain areas, scenic and open space preserves, coastal ecosystems, marine resources or other natural and environmental resources in the area. Thus, the proposed request and use of the property will not adversely impact those resources. Finally, because the property and surrounding areas have been extensively altered and developed with urban uses, it is not anticipated that endangered or threatened candidate species of flora or fauna are located within the subject property, nor has the area been identified as a significant botanical or biological habitat. The property as well as the surrounding area has been fully developed with the residential uses and therefore, the protection of traditional and customary Native Hawaiian rights in the area do not apply. Arakaki, Chairman and Members of the County Council Page 7 Based on the above findings, approval of the Change of Zone request from Single Family Residential (RS-10) to the General Commercial (CG-10) zoned district would result in an appropriate land use pattern that will further benefit the public. Brilhante Self-Directed IRA has submitted an application for a Change of "Lone by changing the district classification from Single Family Residential (KS-10) to General-Commercial (CG-20) for approximately 23,761 square feet of land. The property is located in Waiakca House Lots 2°d Series, on the west side of Kilauea Avenue, adjacent and south of YWCA Office (former Hal's Radio & TV Service), Waiakea, South Hilo, Hawaii, TMK: 2-2-24:12. GF,NERAL INFORMATION 1. Land Ownership: Real Property records indicate that Ichiro and Jeanette Matsunaga are the property owners. However, the applicant has submitted a deed showing the transfer of the property to First Hawaiian Bank, Trustee of the William V. Brilhante Self-Directed IRA. PROPOSED DEVELOPMENT 2. Request: The applicant is requesting the change of zone in order to construct an approximately 8,000 square foot one-story office building with 36 parking stalls. The applicant has been approached by prospective tenants who are interested in office-type uses. According to the applicant, the approval of this request would allow for greater flexibility to accomrriodate commercial uses and respond to community and market demands more readily. The applicant proposes to demolish an existing single family residential structure that was built in 1934. 3. Conceptual Site Plan: The proposed 100x80-foot building will be located toward the rear portion of the property that would provide spaces fo'r about 10 tenants. The site plan shows that the proposed building will be 10 feet setback from the rear property boundary, 4 feet setback from the north bomldary, and zero feet setback from the south bowidary. The 36-stall parking area, including 2 accessible parking spaces for persons with disabilities, would be situated on the front portion of the property. The site plan also shows landscaping along the parking area on both side property boundaries. 4. Supportive Information: The applicant has submitted the following in support of the request: (See Exhibit A -Change of Zone Application) 5. Notification to surrounding property owners: The Planning Department Sles reflect that the applicant has served two notices, as required, of the application to the surrounding property owners. STATE AND COUNTY PLANS 6. State Land Use District: Urban. 7. General Plan Consistency: Goals, policies and courses of action of the Economic and Land Use Elements. 8. General Plan Land Use Pattern Allocation Guide Map (LUPAG) Map: The area is designated for High Density Urban Development. County Zoning: Single Family Residential (RS-10) since 1967, the adoption of the Zoning Code and City of Hilo Zone Map. ] 1. Previous Rezoning of Subject Property: The property was rezoned from Single Family Residential (RS-] 0) to Office Commercial (CO-20), by Ordinance No. 83-55 (REZ 458), effective December 12, 1983. The original landowner, Mr. Ichiro Matsunaga, at that time proposed to lease the existing single-family dwelling for conversion into office uses. Subsequently, by letter dated April 21, 1986, the owner requested that the zoning revert back to RS-10. The Ordinance No. 83-55 was repealed by Ordinance No. 86-88, effective August 19, 1986, which redesignated the property to RS-10. ]2. Coastal Zone Management, Chapter 205A, HRS: The entire State ofHawai`i lies within the Coastal Zone Management Area. The intent of the Coastal Zone Management Program is to guide and regulate public and private uses in the coastal cone management area with respect to recreational resources, historic resources, public access to the shoreline, scenic and open space resources, coastal ecosystems., marine resources, economic uses, coastal hazards, managing development, public participation, and beach protection. 13. Special Management Area (SMA): The Special Management Area is a part of the Coastal Zone Management Program and regulated by the County. The property is not situated within the Special Management Area. It is located approximately three miles from the nearest coastline and outside of the tsunami inundation area. DESCRIPTION OF SUBJECT PROPERTY AND SURROUNDING AREA 14. Waiakea House Lots 2"~ Series Subdivision: The Waiakea House Lots 2°d Series was created in 1923, with average lot sizes of 20,000+ square feet. Those lots are bordered by Mohouli Street, Kino`ole Street, Kawili Street and Kilauea Avenue. Over the years, the parcels within the subdivision were further subdivided, creating smaller residential lots. Most of the dwellings in the subdivisions were constructed since the 1920's. 15. Subject Property: The property has frontage along Kilauea Avenue. It is rectangular shaped, with an unoccupied single-family dwelling, and landscaped with grass and trees. l6. Surrounding Zoning/Land Uses: Adjacent and to the north is the YWCA's Healthy Start Program (previously HaPs Radio and TV Service). Adjacent and to the south is Kilauea Plaza, primarily an office building. Beyond Kilauea Plaza is the Kilauea Kitchen Restaurant and Hilo-Shi Bento Ya & Bakery, Tykes Laundromat and Personal Touch Dry Cleaning. The property across of Kilauea Avenue is presently vacant of any structures or uses. These parcels are as follows: (See Exhibit B - 7,one Map) A. TMK: 2-2-24:1 Ordinance No. 96-84 (REZ 826), effective July 26, 1996, rezoned the property from RS-] 0 to CG-20 for Wayne Kaneshiro. Presently cleared and vacant. B. TMK: 2-2-24:14 & 1C Ordinance No. 92-26 (REZ 707), effective March 11, 1992, rezoned the property from RS-10 to CG-20 for Sandra Kaneshiro. Presently the site of Kilauea Kitchen Restaurant and Hilo-Shi Bento Ya & Bakery. TMK: 2-2-24:15 & 16 were subsequently consolidated into one parcel. -3- C. TMK: 2-2-24:15 Ordinance No. 89-161 (REZ 651), effective December 22, 1989, rezoned the property from RS- l0 to CG- ] 0 for Sandra Kaneshiro. TMK: 2-2-2829 Ordinance No. 89-50 (REZ 627), effective Apri126, 1989, rezoned the property from RS-10 to CG-10 for Paul H. Rosendahl. Land Study Bureau's Detailed Land ClassiScation System: Lands in the area are classified as within existing urban development. 18. Flood Insurance Rate Map (FIRM): The property is classified as Zone X, areas determined to be outside the X00-year flood plain. 19. Flora/Fauna Resources: Since 1934, the subject property and surrounding area have been previously cleared and developed with residences. Therefore, no rare or endangered species of plants or animals are situated on the property. -4- 20. Archaeological Resources: There are no known historic sites on the property. Because the entire property has been extensively altered by the residential use, it is not anticipated that there are any historic sites. 21. Public Access: There is no public access to the mountains or the shoreline that run through the property. 22. Valued Cultural Resources: The property has been fully developed for residential use and therefore, protection of traditional and customary Native Hawaiian rights does not apply. PUBLIC UTILITIES AND SERVICES 23. Roadway Access: The property is situated on the west side of Kilauea Avenue. The existing paved driveway is approximately 18 feet wide. Other Essential Utilities and Services: Police services are available at the main station on Kapiolani Street and fire protection services at the Hilo Central Fire Station located at the corner of Kino`ole Street and Ponahawai Street. CONFORMANCE WITH STATE/COUNTY PLANS 2) The State Land Use Distract is Urban. 3) 1'he property is not located within the coastal area and does not affect the Coastal Lone Management areas. 4) Goals oC the Gcncral Plan arc to provide residents with opportunities to improve their quality of life with economic developments and improvements in balance with the physical and social environments of the Island of Hawaii. Most importantly, it calls for economic environments which allow for new, expanded or improved economic opportunities al! while striving for full employment. I l stresses the mainlaioing of the quality of the environmcnl and providing for clean industries. 5) The General Plan Land Use Pattern Allocation Guide (LUPAG) Map designates the area for High Density Urban Deg clopment. This designation enables the consideration of commercial rezoning requests of this nature. The request will fulfill the General Plan's overall land use goals which calls for the concentration of commercial activities in a manner commensurate with the necessary infrastructure. The subject property is situated in a manner which fulfills this commercial centralization goal called for in the General Plan LUPAG map. "(d) Vertical Clearance. Fire apparatus access roads shall have an unobstructed vertical clearance of not less than 13 feet 6 inches. "EXCEPTION: Upon approval vertical clearance may be reduced, provided such reduction does not impair access by fire apparatus and approved signs are installed and maintained indicating the established vertical clearance- "(e) Permissible Modifications. Vertical clearances or widths required by this section may be increased when, in the opinion of the chief, vertical clearances or widths are not adequate to provide fire apparatus access. "(f) Surface. Fire apparatus access roads shall be designed and maintained to support the imposed loads of fire apparatus and shall be provided with a surface so as to provide all-weather driving capabilities." (20 tons) "(g) Turning Radius. The turning radius of a fire apparatus access road shall be as approved by the chief." (45 feet) "(h) Turnarounds. All dead-end fire apparatus access roads in excess of 150 feet in length shall be provided with approved provisions for the turning around of fire apparatus. "(i) Bridges. When a bridge is required to be used as access under this section, it shall be constructed and maintained in accordance with the applicable sections of the Building Code and using designed live loading sufficient to carry the imposed loads of fire apparatus. The required width of any fire appar~itus access road shall not be obstructed in any manner, including parking of vehicles. Minimum required widths and clear;~nces established under this section shall be maintained at all times. "(I) Signs. When required by the fire chief, approved signs or other approved notices shall be provided and maintained for fire apparatus access roads to identify such roads and prohibit the obstruction thereof or both." Water supply shall be in accordance with UFC Section 10.301: "(c) Water Supply. An approved water supply capable of supplying required fire flow for fire protection shall be provided to all premises upon which buildings or portions of buildings are hereafter constructed, in accordance with the respective county water requirements. There shall be provided, when required by the chief, on-site fire hydrants and mains capable of supplying the required fire flow. "Water supply may consist of reservoirs, pressure tanks, elevated tanks, water mains or other fixed systems capable of providing the required fire flow. "The location, number and type of fire hydrants connectE~d to a water supply capable of delivering the required fire flow shall be protected as set forth by the respective county water requirements. All hydrants shall be accessible to the fire deparirnent apparatus by roadways meeting the requirements of Section 10.207."
