HomeMy WebLinkAboutRES 066 Draft 01 2002-2004 COUNTY OF HAW ~l~l~` ATE OF HAWAII ti _ i;. RESOLUTION NO. 66 03 RESOLUTION ADOPTING WOOD VALLEY ROAD IN KA`U AS A COUNTY ROAD TO MAINTAIN IN PERPETUITY. WHEREAS, that road known as Wood Valley Road, which is entirely contained within the area described in the attached Exhibit 1 and connects Pahala to Wood Valley in Ka`u, County of Hawaii, comprises the only route open to the public that services Wood Valley; and WHEREAS, Wood Valley Road includes seven (7) bridges; and WHEREAS, Wood Valley Road provides the only means for County maintenance workers to access the County-owned roads within Wood Valley; and WHEREAS, Wood Valley Road sustained approximately $1,000,000 worth of damage by the flood of November, 2000; and WHEREAS, Federal Emergency Management Agency will fund 75% of the cost to repair the aforesaid flood damage only if the County of Hawaii passes a resolution to maintain Wood Valley Road in perpetuity; and WHEREAS, the road existed in its current alignment prior to December 21, 1966, and is not constructed and maintained up to County of Hawaii standards at the present time; and WHEREAS, the mauka portion of Wood Valley Road from approximately the south boundaries of Grants 2386 and 2457 (at the Kanaio-Kaalaala boundary) to the Kapapala School lot (TMK: 9-6-9:4) was opened and laid out by the territorial government and is therefore a government road; and WHEREAS, the ownership of the rest of Wood Valley Road is not known; and WHEREAS, Ka'u Agribusiness Co. and Mauna Kea Agribusiness Co. own the properties adjacent to the road; and WHEREAS, Ka'u Agribusiness Co. and Mauna Kea Agribusiness Co. have executed letters stating their non-objection to the adoption of Wood Valley Road by the County, and their intention to dedicate to the County of Hawaii in the future a fifty (50) foot right-of-way in which Wood Valley Road would be more or less centered; and WHEREAS, no person has exercised any act of ownership over the road for more than five (5) years; and WHEREAS, Wood Valley Road is not listed by the State of Hawaii Department of Transportation as under its jurisdiction; and WHEREAS, Hawaii Revised Statutes, Section 264-1(c)(2) provides that where no act of ownership has been exercised over the privately laid out road, way, or lane for more than five (5) years and, in the case of a County highway, where the legislative body has adopted the same by resolution, the road, way, or lane shall become a County highway. BE IT THEREFORE RESOLVED, by the Council of the County of Hawaii, that Wood Valley Road is hereby adopted as a County highway, pursuant to Hawaii Revised Statutes, Section 264- 1(c)(2); and IT FU~iT~l~R ~FSOLV~D that the Clerk file a certified copy of this resolution with the State E~ureau of Conveyances and provide further copies to the Mayor, the Director of ~'ublic Works, and the Director of Finance of the County of f-lawai'i.
