Puna Emergency Access Road (PEAR) Gate Removal
"phis is to transmit Resolution No. 6~-03, Draft 2, which makes the fi~llowing changes to Draft 1
in view of the County administration's recent construction ofi a new gate across the Puna
Emergency Access Road:
1. Delete the tirst WHEREAS and replace it with:
WHEREAS, in April 2003, the Public Works Deyartrnent installed a metal =sate
on county roadwa~propert~(Tax Map Key 1-6-45:073'1, which is part of the Puna
EmerQenc~4ccess Road (PEAR); and
2. Delete the second WHEREAS entirely.
3. Modify the lust NOW, TI IRREFORE, BE IT RESOLVED clause as follows:

COUN"TY OF I?AWAI'I that, in accordance with the Hawaii Revised Statutes
and in the interest of the public, the Council urges the Mayor and the Department
of Public Works to initiate the immediate removal of the gate erected on County
roadway property (TMK: 1-6-45:073). which is part of the Puna Emergency
Access Road (PIiAR) by the Ainaloa Community Association].
