RESOLUTION NO. 65 03

A RESOLUTION URGING THF. MAYOR AND THE DEPARTMENT OF
PUBLIC WORKS TO INITIATE, THE IMMEDIATE REMOVAL OF THE GATE,
LOCATED ON COUNTY ROADWAY PROPERTY, WHICH IS PART OF THF.
PUNA EMERGENCY ACCESS ROAD.
WHEREAS. in April 2003, the Public Works Department installed a metal gate
on county roadway property (Tax Map Key 1-6-45:073), which is part of the Puna
Hmergency Access Road (PEAR): and
WHEREAS. Hawaii Revised Statutes. Chapter 264-I(d), mandates that "all
county public highway, and trails once established shall continue until vacated, closed.
abandoned or discontinued by a resolution of the legislative body of the county wherein
the county highway or trails lies;" and
WH[?REAS. to date, neither public forum nor Council action has taken place
around this road closure.
NOW. THEREPORI?. BF: IT RESOI,VI?D BY TH[? COUN('lI. OP "I~HE
COUNTY OF HAWAII that, in accordance with the Hawaii Revised Statutes and in the
interest of the public. the Council urges the Mayor and the Department of Public Works
to initiate the immediate removal of the gate erected nn County roadway property (I'MK
1-6-45:073), which is part of the Puna Emergency Access Road (PEAR).
BE IT FUKTHL R Rh;SOLV ED that the Council requests this action be completed no
later than July 1. 2003.
BL I'1' PINALI.Y RESOLVI~:D that the Office ofthe County Clerk is hereby directed to
forward copies of this resolution to Mr. Bruce McClure. Director of the Department of Public
Works, the Honorable Hany Kim. Mayor; and Mr. Lincoln Ashida, Corporation Counsel.
