AN ORDINANCE AMENDING CHAPTER 2, ARTICLE 24 OF THE HAWAII
COUNTY CODE 1983 (1995 EDITION) RELATING TO THE SERVICE
CHARGE ASSESSED FOR PAYMENT TO THE COUNTY THAT IS
SUBSEQUENTLY DISHONORED
BE IT ORDAINED BY THI: COUNCIL OF THE COLiNTY OF HAWAII:
SECTION 1. Chapter 2, article 24, section 2-134, of the Hawaii County Code 1983 (1995
edition), relating to service charge assessed for payment made to the County that is subsequently
dishonored, is amended to read as follows:
Article 24. Payment to County [by Negotiable Instrument], Subsequently Dishonored.
Section 2-134. Service charge assessed.
In all instances where money due the County of Hawaii [is paid by check or other negotiable
instrument and the check or other negotiable instrument] is dishonored when presented for payment,
the County may assess and collect a service charge in the amount of [$7.50] $20.00 against the payor
[maker of the check or negotiable instrument]. Payment of this [$7.50] $20.00 service charge shall be
made in U.S. currency or other form acceptable to the director of finance. All fees collected pursuant
to this section shall be placed in the custody of the finance director for deposit in the general fund.
SECTION 2. Material to be repealed is bracketed. New material is underscored. [n printing
this ordinance, the brackets, bracketed material and underscoring need not be included.
SECTION 3. If any provision of this ordinance, or the application thereof to any person or
circumstance, is held invalid, such invalidity shall not affect other provisions or applications of the
ordinance which can be given effect without the invalid provision or application, and to this end, the
provisions of this ordinance arc declared to be severable.
SECTION 4. This ordinance shall take effect upon its approval.
