RESOLUTION NO. 65 03

A RESOLUTION URGING THE MAYOR AND THE DEPARTMENT OF PUBLIC
WORKS TO INITIATE THE IMMEDIATE REMOVAL OF THE GATE LOCATED ON
COUNTY ROADWAY PROPERTY, WHICH IS PART OF THE PUNA EMERGENCY
ACCESS ROAD.
WHEREAS, in May 2002, the Ainaloa Community Association, Inc. installed a metal gate across
the Puna Emergency Access Road (PEAR); and
WIiERF,AS, the Department of Public Works subsequently discovered that this gate sits on
public roadway property owned by the County of Hawaii, identified as Tax Map Key I-6-45:073; and
WHEREAS, Hawaii Revised Statutes, Chapter 264-I(d), mandates that°all cowrty public
highways and trails once established shall continue until vacated, closed, abandoned or discontinued by a
resolution of the legislative body of the county wherein the county highway or trails lies;" and
WI IEREAS, to date, neither public forum nor Council action has taken place around this road
closure.
NOW, THEREFORE. [3E IT RESOLVED BY THE COUNCIL OP THE COUN"hY OP
HAWAI`1 that, in accordance with the k lawai`i Revised Statures and in the interest of the public, the
Council urges the Mayor and the Department of Public Works to initiate the immediate removal of the
obstruction caused by the gate erected on County roadway property (TMK I-G-45:073), which is part of
the Puna Emergency Access Road (PEAR).
BE IT FURTHER RESOLVED that the Council requests this action be completed by July 1, 200 ~ or its
best effort.
BE IT FINALLY RESOLVED that the Office of the County Clerk is hereby directed to forward copies of
this resolution to Mr. Bruce McCli.ire, Director of the llepartment of Public Works, the Honorable Harry Kim,
Mayor; and Mr. Lincoln Ashida, Corporation Counsel.
