HomeMy WebLinkAboutCOM 0224.009 2002-2004May 5, 2003 To Honorable Council Members & Interested Parties; We the GREAT majority of Ainaloa Owners and residents wish to let you know that as the present road is unsafe for the Highway speeds and heavy traffic which will occur if it is opened as a by pass road between lower Puna and upper Volcano area. Children waiting for the school bus along the roadway are now being subjected to vehicles moving at high speeds through the 25MPH + 15 MPH zones by trespassers using the ILLEGAL TOLL BOOTH road at the top of Ainaloa Boulevard which crosses County property through a private lot and onto Stardust Drive & Ainaloa Boulevard. Several County, State and Federal agencies have been contacted to try to shut this illegal toll booth and roadway, but no one seems to care, the toll booth is still in operation and collecting fees to pass. We the owners and residents of Ainaloa would like to let everyone know that we have been misrepresented by the District representatives from our area. We would like everyone to know that Jacobson & Safarik, by no means represent the members of the Ainaloa Association or any of its Board Members. On the contrary we have been berated and had rumors of no substance started by Safarik and Jacobson in various local publications and the Puna News and Tribune Herald. We only want to have a safe and healthy atmosphere for all of the Puna residents, but the road NEEDS to be improved to County Standards before it is turned into a HIGHWAY with MAJOR TRAFFIC. I live along side this road and see the high traffic and speeding on a constant basis, at times people are traveling well over 60 MPH and passing slower vehicles, over a double solid line, on a road with no shoulders, it can get pretty scary at night. An illegal and un permitted road runs through County Property through TMK #(3)1-6-065-108 onto Ainaloa Boulevard. This situation is causing health and safety problems for Ainaloa residents. Traffic, speeding and thefts are increasing this Lot has un permitted buildings and illegal sewage disposal system which smells at times and is in close proximity to the toll booth where food and drink is exchanged for passage in lieu of cash sometimes. Please help us remove this dangerous situation from our subdivision where the maximum speed limit is 25 MPH and not up to standards for highway speeds and traffic increase, which is dangerous for children who wait for school buses right along the Boulevard in the morning, where the speeds go well above 50 MPH is common. R3 Box 1274, Pahoa, HI 96778 March 10, 2003 Bear Friends; The annual meeting of the Association is over and we are un— certain as to what effect our efforts have had or if thev will change anything in the operation or benefit to the subdivision. We can say that we did out best, on short notice, and who knows what the next few days will bring. When we arrived at the meeting, the office had discounted over half of the proxies that we turned in to them. Their reason being was their assertion that those proxies were not valid because the owners were in arrears(non—payment of Association assessment). If you have any comment about this, we would certainly appreciate hearing from you again. There are several other groups, in the subdivision, questioning the actions of the Board of Directors. A tali for a recount of both the proxies and ballots is being asked for b7 all these groups. The new bookeeper reported that there are inaccuracies in the financial records, so both the Treasurer's Report and the proposed Budget were approved subject to audit. There is an audit of the Board's actions going on now. The motion to approve all of the actions of the Board, for this year, was defeated resoundingly. To date, there ire two lawsuits filed against the Association. Payment for settlement of these cases are listed in the budget., at a cost to us, as $50,000. These cases have been filed by two current employees of the Association.One of these people was elected at the meeting to serve on the Board of Directers for the upcoming year. Despite what happend at the meeting, we feel that a clear mess— age was sent to the Board. We are not happy with their behavior. They do not have the right to ignore the wishes of the members nor to disrespect the members right to privacy in their own homes or on their own propertv,as long as they obey the laws of the area in which they live.G@ Thank You again for your trust in us.
