Teixeira B Vice Director of Civil Defense y State of Hawaii Civil Defense 3949 Diamond Head Road Honolulu, HI 96816-4495 Re: FEMA 1348 DR-HI PA 001-021DC-06 PW 185, Wood Valley Road Dear Mr. Teixeira: Thank you for your letter of October 31, 2001, which forwarded a copy of the County of Hawai`i's letter of October 17, 2001, requesting approval to proceed with work on Wood Valley Road, Project Worksheet number 185. In order for the County to be eligible to be reimbursed for this project, documentation of a legally binding agreement to maintain this project in perpetuity will be required. Proper documentation would be minutes of the County Council meeting adopting this road and its continuing maintenance. This action is required because of the regulation located in 44 Code of Federal Regulations § 206.223 General Work Eligibility. (a) General. To be eligible for financial assistance, an item of work must: (1) Be required as the result of the major disaster even[, (2) Be located within a designated disaster area, and (3) Be the legal responsibility of an eligible applicant. In response to the County's comments regarding their March 30, 2001, letter concerning the need for the bridge at Site B, to be sufficient to pass the maximum peak flood per County standards, the determination has been made [hat the County does not have legally binding codes. Therefore, the bridge should be replaced to pre-disaster dimensions. "I'he concern regarding the bridge removal cost being too low should be resolved when the bids are submitted. Since actual, reasonable costs will be reimbursed for this large project, the estimate will stand. The Case Management File will be noted regarding the need for concrete wall removal and disposal. The County should include this item in their plans for the repairs. Any adjustment needed after receipt of bids will be made in a version of the existing project worksheet. Comm. No. Ref. To~~~ Ref.
