Balog Chairman HAWAII COUNTY PLANNING COMMLSSION 25 Aupuni Street Hilo, Hawaii 96720 Re: Subdivision Code Revision Dear Mr. Balog: The Planning and County Issues Committee of the Hawaii Leeward Planning Conference would like to submit the following comments on the Iuly 31, 1995 draft and the April 8, 1996 summary of comments: 1. neral Overall, there aze a lot of ideas in the code we feel aze very positive. We pazticulazly support the effort to include graphic tables and illustrations where possible. 2. Soecific section comments: A. Section 23-3- Phased Development. We recommend deleting the entire third sentence which now reads: "The basis for the required improvements for the overall tract development shall be documented in a development agreement pursuant to chapter 30 of the County code.". B. Section 23-3-2. Application involving both land court and regulaz system lands. We recommend adding the words "where feasible" in front of the proposed language which now reads "No proposed lot shall include a mix of lands registered in land court and unregistered lands.". C. Section 23-4-24. Right of Way Width, Pavement Width, Sidewalk and Curb Requirements. section (b) (2). We recommend restoring the following language "Planting strip. Date _.71997.__.._ of grassed or landscaped area at least two feet wide plgy (not shall) separate sidewalks from adjacent curbs in azeas zoned residential with a minimum lot size of 10,000 s.f. or less; in all other areas the sidewalk may extend to the curb.". D. Section 23-4-26. Grades and Curves. a recommend adding the word "average" to the last sentence so that it reads "In no event, however, shall the average street grades exceed the following:...". E. Section 33-4-37 of Division 7. Wastewater Sewer Systems Available. We recommend adding the following phrase to the beginning of the second sentence: ""When required by the State Department of Health" sewer lines shall be installed...". F. Section 23-4-39. General of Division 8. Drainage (paragraph (b), first sentence). We recommend adding the word "swales" after "grassed" and adding "within the right of way" at the end of the sentence after "practicable". 3. Section 23-4-24. Right of Way Width, Pavement Width, Sidewalk and Curb Requirements. We recommend revision of table 1 on page 72 of code revision draft dated 7/31/95 to read as follows: Table 1.
