RESOLUTION NO. 78 03
RESOLUTION AUTHORIZING ~~HE DIRECTOR OF FINANCE 'f0 QUITCLAIM A PORTION OF THE
COUNTY'S INTEREST, AND TO GRANT A RIGi{T-OF-ENTRY TO A PORTION OF KLJLAIMANO
HOMESTEAD ROAD, IDENTIFIED AS PARCELS I(REV. 1) AND 4(REV. 1), CONTAINING AREAS OF
APPROXIMATELY 1600 AND 1200 SQUARE FEET RESPECTIVELY, BETWEEN TAX MAP KEY
PLATS: (3)2-8-016 AND 2-8-020. AND PLATS (3)2-8-016 AND 2-8-019 RESPECTNELY, TO THE
STATE OF HAWAI`[.
WHEREAS, the State of Hawaii, Department of Transportation, requires a portion of the Kulaimano
Homestead Road, situated at Kulaimano and Pepeekeo, South Hilo, County of Hawaii, State of }lawai`i, in
connection with the proposed highway project No. HWY-H-07-00 (hereinafter "highway project"); and
WHEREAS, Kulaimano Homestead Road is owned by the County of 1 lawai'i; and
WHEREAS, pursuant to Hawaii Revised Statutes Section 264-2. if a County highway is required by the
State for State highway purposes, the ownership of the County highway shall he transferred to and vested in the
State without compensation; and
WHEREAS, the highway project consists of widening the Hawaii Belt Road/Kulaimano Road
intersection, which will provide left-turn lanes for traffic turning in to North and South Kulaimano Road, the
installation of additional street lights, and providing adequate sight distance for vehicles exiting North
Kulaimano Road; and
WHEREAS, in order that the highway project may proceed without delay, aRight-of=Entry to
Parcels 1(rev.l) and 4(rev.l pending the execution of the Quitclaim Deed conveying the parcels to the State is
required; and
WHEREAS, Hawaii County Charter Section 13-21 requires County agencies, in the performance of
their functions, to cooperate with State government agencies having similar functions, and the County of
Hawaii Director of Public Works recommends approval of the subject highway project; and
WHEREAS, pursuant to I?-~wai`i Revised Statutes Section 46-8, the County Council may enter into
agreements with the State govenjnjent for the co-sponsorship and joint development and maintenance of
programs and projects, within and for the County, which have been authorized by the Legislature or for which
moneys have been appropriated by the Legislature.
NOW, THEREFORE, I3E IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII, in
accordance with Hawaii Revised Statutes Section 45-8, that the Director of Finance of the County of Hawaii is
authorized to execute, on behalf of the County, the Quitclaim Deed and Grant ofRight-of--Entry in substantially
the form attached hereto and incog~porated by reference herein as Exhibit "A" to enable the State to proceed with
the highway project described herein.

GRANT OF RIGHT-OF-ENTRY:
I, the undersigned, hereby grant the State of Hawaii, Department of Transportation, right-of-
entry upon and possession of the following portions of Kulaimano Homestead Road:
Parcel Tax Map Key Area
I (Rev.l) between TMK 2-8-16 and 2-8-20 1,600 sq ft
4 (Rev. 1) between TMK 2-8-16 and 2-8-19 1,200 sq ft
required for the constn~ction of Hawaii Belt Road, Traffic Operational Improvements to Existing
Intersections and Highway (Hawaii Belt Road -Kulaimano Road Intersection), Project No.
IIWY-H-07-00 at Kulaimano and Pepeekeo, South Hilo, Island of Hawaii, State of Hawaii,
effective upon construction start date, pending execution of the Quitclaim Deed transferring the
parcels to the State of Ilawaii.
