Dear Honorable Arakaki and members of the Council:
Subject: BiII No. lU3 (Rezonin¢ Request - TMK: 7-4-3: 7
As you are aware, this matter was favorably considered by your Planning
Committee at its meeting of May 6, 2003. This matter is now before the Council for
consideration on first reading.
At the Planning Committee meeting, Councilperson Curtis Tyler raised two
questions. First of all, he wanted to know whether the landowners have consented to the
proposed conditions outlined in the subject bill In that regard, please find enclosed a
letter from the landowners outlining their awareness of and none objection to the
proposed conditions.
The second question related to the applicant and/or landowners ability to use the
homestead road along the south end of the subject property. This was raised because of
an apparent "gate" constructed across of that road. Please be informed that that road is a
public road and should technically not be gated. Notwithstanding that fact, I was verbally
informed by the landowners of the subject property earlier this week that as Tong as that
gate is there, they will be given a key to it. As such, one way or the other, the applicant
and landowners will not have any legal or practical access to the use of this road.
