Dear Mr. Chung:
Thank you for taking time to converse with me last Thursday. I'm aware there is, what 1 think to be, a
vote next week on the 23`d on the smoking ban issue. I apologize for my demeanor on the phone; ]can
assure you it was not directed at yuu but rather the council members who are unable to understand that
you just can't please all the people all the time through legislation. I have to return to Phoenix on
business next week and will be able to attend this momentous event.
As I mentioned, I am forming a petition to make the council members aware of the impact the smoking
ban measure will have on my establishment and others as well. There has not been a single patron of
Charley's, smoker or non-smoker, who has not agreed with the petition. This in itself demonstrates how
my world operates. The vast majority of Charley's patrons are in favor of my choice to permit smoking
at Charley's and at the very least, they respect my desire to operate my business as [desire not as the
Council desires.
Charley's is an adult establishment: therefore I recommend that you remove children from the equation
all together. If the council desires to provide capital for the creation of a family eating establishment_ the
more business and employment opportunities in Hilo the better. Good luck. I wish the same such luck
for the complaining non-smokers and encourage them to finance and operate an establishment catering
to their needs, wants and desires. It's unconstitutional for anyone or any entity to demand I operate mine
based on their parameters.
Regardless of the economic issues involved with allowing or not allowing smoking at Charley's, my
primary difficulty with this demand has to do with the democratic society which we formed almost 230
years ago and understandings which were embedded into our bill of rights and constitution, freedom of
choice being on equal ground with freedom of religion, etc.
Apparently this concept escapes many non-smokers and select members of the council. 1 chose to allow
smoking at Charley's, and for those who have health concerns, I would recommend they avoid bars
altogether as a bar generates revenue by marketing a substance which is not healthy to begin with. The
target market which I chose is athirty-something crowd. I don't target younger crowds and although
families do patron from time to time, That is not what I'm targeting. If I wanted to target families and
non-smokers, Charley's would already be anon-smoking establishment and we would be a restaurant
with liquor supporting food sales rather than a bar with food supporting the liquor sales.

My percentages reflect a 60%/40% liquor to food respectively, which demonstrates that I am a bar first
and a restaurant second. Forcing me to be a restaurant first, can almost guarantee a much higher food to
liquor ratio and drive this business from one-million dollar per year gross sales to about $500,000 to
$600,000 per year gross business with 60% of that being food sales. I would not be appreciative of your
reorganization efforts on what I have built. Let me highlight a few bullet points of what your meddling
will result in here, and long-term plans which I would now change.
• Difficulty in controlling liquor consumption.
a) With smokers exiting and entering the facility during the course of the night, controlling
the transport of liquor out of my building will be extremely difficult. Patrons have
already been caught trying to carry their beverage outside the building. Now that they
have an excuse to g~~ outside, monitoring this is going to be next to impossible. The face
of my building is completely open.
b) With customers going out to the parking lot to smoke, drinking in their vehicles will be a
frequent event and 1 will be unable to monitor consumption placing Charley's in a
position of liability without control.
• Building lease
a) Had 1 known of the possibility of a smoking ban, I would not have recently signed
another 5-year Ieasc option with my landlord. I'd have anticipated the loss in revenue
which affects my ability to satisfy that liability.
• Customers surveyed
a) Happy hour customers that enjoy coming to Charley's. are primarily blue collar workers.
1 have already been informed by virtually all of them, that they will now patron another
establishment which will be exempt from the smoking ban because they do not serve
food. Their non-smoker friends will also do the same to follow them for the socializing
they had been coming to Charley's tor.
• Entertainment Nights
a) Our menu at Charley's closes at 9:OOpm making Charley's a bar only after that time. No
revenue is generated at all in food sales after that point. IIowever Charley's will be
denied the option to smoke because of the meager 40% in food sales occurring in the
afternoons.
• Unemployment
a) Despite any delusions, Hawaii is a welfare state, especially the Big Island. 'The drop in
revenue will result in layoffs reducing taxes to the state, increasing unemployment and
unemployment benefits. Hawaii should be encouraging business and assisting in the
creation of state revenues and jobs.

In closing, This is a bar. A bar that serves food, and our percentage of food to liquor supports that
fact. More importantly, lt's my bar not yours to play with as you see fit. Keep your laws off it.
Liquor and food sales represents a double edge sword. Higher food sales means lower liquor liability
insurance premiums. Now, the higher food sales that I have worked hard to attain to lower those
premiums, will affect my liquor sales by driving off the customers that support this establishment.
This establishment serves our clientele well and barring your involvement, will continue to do so.
Your statistical information regarding smoking and smokers may work for Hilo, but it does not
reflect the demographics of Charley's.

c) We are a bar & grill. Minors are not permitted at our establishment al all when our kitchen is closed and only with a guardian
at all other times. Charley's is not known as being a family dining establishment. We're ok with that and our customers arc as
well. Why can't our government be comfortable with that and keep their laws off this facility?
d) Charley's generates greater than 25°.'0 of total revenue from food sales, but that 25% or better occurs within 5 hours of a 17-
hour day, lunch and dinner. Our revenue comes from liquor sales. The 25% maximum will result in a 30% overall loss in
revenue resulting in lay-offs and more unemployment for the state adversely afFecting an already troubled economy.
e) If the driving motivation behind this bill is the good of public health should you not legislate a ban or liquor consumption as
well? How many non-smokers do you know that go to a bar for health reasons?

Smoking ban
A petition Cor legislators to not pass the smoking ban bill
Seifert Enterprises, Inc., D.b.a. Charle}'s Rar & Grill, strongly disagrees with the bill before the Hawaii County Council regarding the
proposed smoking ban. Currently, the ban includes establishments that generate 25"/0 or greater in total revenue from food sales and
additionally states that establishments offering live entertainment and dancing is to beoff-limits to smokers. Charley's is opposed to
this ban as it is found to be ambiguous, discriminatory and an example of government infringing on the rights of individuals and
private business. Please note the following points, if you agree with our position, please sign this petition to inform our political
representation that as a voter, you will ?ot tolerate having our rights revoked through over legislation.
a) Dancing is only offered after 9:OOpm Thursday ihru Saturday after our kitchen closes. Your menu is not available, does that
not make us a bar only and not a restaurant thus making us exempt from the ban? Ambiguity?
b) One of our constitutional rights i> the freedom of choice. As the owner of Charley's is it not my right to operate my business
as I chose' Is it not the choice of our patrons to make the choice not to visit Charley's because smoking is permitted?
C) We are a bar & grill. Minors arc not permitted at our establishment at all when our kitchen is closed and only with a guardian
at all other times. Charley's is not known as being a tamily dining establishment. We're ok with that and our customers are as
well. Why can't our government be comfortable with that and keep their laws off this facility?
d) Charley's generates greater than '_5°~0 of total revenue from food sales, but that 25°-0 or bener occurs within 5 hours of a 17-
hour day, lunch and dinner. Our revenue comes from liquor sales. The 25% maximum will result in a 30"/0 overall loss in
revenue resulting in lay-offs and more unemployment for the state adversely affecting an ah~eady troubled economy.
