compliance with Condition S of the Change of Zone Ordinance No. 02-26 (REZ 979).
We have also recently received a copy of the Traffic impact Analysis Report (TZAR)
from Hida, Okamoto & Associates, Inc. in compliance with Condition K.

Dear Mr. Yuen:
In compliance with Condition S of our Change of Zone Approval, dated May 23, 2002, we
are required to submit to you an annual progress report addressing the status of the
development and the compliance with the conditions of approval. This letter is intended to
serve that purpose.
First, in general, the area is being redesigned to subdivide into two parcels: one for the
County Fire Station with a satellite police office, and a second lot that is to be designed via
a CPR for three commercial uses. These are being planned for a gasoline service station,
a convenience store, and aquick-service restaurant, all requested neighborhood uses.
The fire station is under contract for design by Oda/McCarty in Hilo and working plans are
undervvay.
As to the conditions - A, B, and C are being complied with (the Water Commitment
Deposit was paid May 29, 2003). Condition D allows for five years to complete the
conditions and we are in compliance with it by virtue of the current timing.
Conditions E and F in reference to roadways, are being planned according to the
requirements of the conditions. Condition G regarding drainage is being engineered by a
licensed civil engineer. We have also begun our permit application process for the
NPDES permit through Hida Okamoto & Associates, Inc. -civil engineers that specialize
in this.
Conditions H, I, J , and K dealing with the highway traffic, access, and design, including
the Traffic Impact Roport, have been ordered and are in progress through our traffic study
consultant/engineer, Warren Yamamoto. Mr. Yamamoto is working directly with the
County and State traffic departments.
Condition L is being executed by way of coordinated planning between the Fire Chief and
the Fire Station architect, Russ Oda. As our users are identified for the planned CPR lot,
we shall work out the interior design details to comply with Conditions M, N, and O, and O.

Condition P has already been reviewed and cleared. Condition R, regarding a future
Unified Impact Fee Ordinance, is being mitigated by Corporate Council for credits with the
Fire Station. Condition S refers to this subject Annual Report. Condition T for time
extensions, is not applicable at this juncture in the time period.
And finally, we submit this report to comply also with Condition U for timely compliance.
We apologize to the Director and the Council for surpassing the one-year target of the
effective date, as our own suspense files were just updated for this project.
