No. 95-70 as amended by Ord No. 98-63 (REZ 798) Applicant: Kealakekua Development Corporation (Koa Road LLC) Subject: Time Extension Request & Request for Forest Management Plan Tax Map Key: 8-2-012: 012 and Portion of 1 This is to acknowledge receipt of your letter dated July 2, 2003, requesting an administrative extension of time in accordance with provisions of Condition B to comply with the conditions of Change of Zone Ordinance No. 95-70 as amended by Ord. No. 98- 63. In reply to the two (2) prior submittals of the required annual progress reports (March 19, 2001 and Apri124, 2002-copies enclosed), we have requested a status report on the ongoing reforestation efforts and the progress in the development of the Forest Management Plan as required under Condition S of this rezoning. We were informed in a status report on May 23, 1997 from Sandra Schutte that such a plan was being worked on by Mike Robertson and that the plan could be submitted within a year. As of the above listed date, we have not received a Forest Management Plan. No. 98-63 Tax Map Key: 8-2--12: 012 and Portion of 1 In accordance with the provisions of Condition B of Ordinance No. 98-63, Koa Road LLC is recaesing a time extension of one (1) year to comply with the following condition: The effective date of the change of zone shall be when the applicant provides assurance satisfactory to the Departments of Water Supply and Planning, upon consultation with the State Department of Health and the Department of Land and Natural Resources, that a water source(s) of sufficient quality and quantity has/have been established within five years from the enactment of this amendment; provided that a maximum one year extension may be granted by the Planning Director with reasonable and sufficient justification. The water system that will be developed shall be in accordance with the requirements of the Rules and Regulations and the Water System Standards of the Department of Water Supply and shall provide sufficient water capacity and pressure for: 1. domestic purpose for approximately 70 lots makai (west) of the subject property and located within current Tax Map Key Plat 8-2-001; and 2. fire protection pi.irposes with fire hydrants along Koa Road and Greenwell Mountain Road meeting with the approval of the Fire Department. As indicated in my letter of March 24, 2003, Koa Road LLC recent purchased Kealakekua Ranch from Kealakekua Development Corporation. Koa Road LLC is still in the process of assessing its development options for the subject property. Until iC can finalize its development plan, it cannot determine the amount of water that will be required to support the project nor the preferred location of the wells/water system ~ ~ Christopher J. Yuen July 2, 2003 Page No. 2 Accordingly, Koa Road LLC is requesting a one year time extension to provide it with sufficient time to finalize its development plans and implementation strategy. Again, we will keep you appraised of the plans for the property as they are finalized. Your timely action on this request is greatly appreciated. Portion of 1 This is of the above-rcferencec! Change of Zone Ordinance No. 98-63 that amended Change of Zone Ordinance No. 95- 70. An annual progress report was due on March 1, 2001. In preparing. this report, please also include a status report on Condition S, which required the submittal of a Forest Management Plan for the 8,100 acre site zoned A-8000a. An earlier status report dated May 23, 1997 from Sandra Schutte stated that a Forest Management Plan was being worked on by Mike Robertson, with anticipation that the plan could be submitted within a year from thaC date. Our files do not reflect the receipt of subject report. ' According tv Condition S, the forestation plan shall be included in restrictive covenants, with a recorded copy of the covenant to be filed after securing final subdivision approval of the first increment. Although, this condition is not a requirement to be immediately fulfilled, we would like to see a copy of the plan submitted to us in a timely manner. Therefore, please provide us with a status report on your present ongoing reforestation efforts and your progress in the development of a Forest Management Plan for the subject properties. By copy of this letter we will forward your report to the County Council and Planning Commission for their reference. We look forward to the submittal of the next annual progress report on or before March 1, 2003. We understand ftom your letter that the property is in the process of being sold to the Gourley Trust. When that e.rchange is completed, we would appreciate being contacted by the new owner or representative o f the trust regarding their intentions to comply with the conditions of the rezoning ordinance and additional permits referenced above. In particular, Condition B(1) of the above referenced ordinance requires that an approved water source of sufficient qu,vltity and quality be established on or before July 10, 2003 for the rezoning to become effective.
