Subject: DRAFT OF A RESOLUTION NO. 80-03 AUTHORIZING THE'
EXTENSION OF THE PUBLIC SEWER AND REIMBURSEMENT
FOR THI? COST OF CONSTRUCTION OF THE EXTENSION
Enclosed for your favorable consideration is draft 2 of a proposed Resolution No. 80-0
authorizing the extension of the public sewer and the reimbursement for the cost of
construction.
Changes were made to the title of the resolution.
RESOLUTION AUTHORIZING THE ~ EXTENSION OF THE PUBLIC SEWER
(TOJ ALONG ~KALANI~ KALAWA STREET; AND 2) REIMBURSEMENT FOR
THE COST OF CONSTRUCTION OF THE EXTENSION FOR TANTE AND
ARACELI URBAN, AT KAILUA-KONA, HAWAII

The 2"d WHEREAS which reads:
WHEREAS, sewer extensions are beneficial to the community by eliminating
existing cesspools and reducing the amount of pollutants reachink the groundwater and
the coastal waters, resulting in a cleaner, healthier environment; and
The 3rd WHEREAS which reads.
WHEREAS, Section 21-26, Hawaii County Code, requires that all sewer
extensions shall be approved by resolution of the County Council• and
The 6`~' WHEREAS which reads:
WHEREAS, in accordance with Section 21-28(a) of the Hawaii County Code,
the applicant may receive for ten years after completion of the extension one-half
of all moneys for sewer charges collected by the County from other properties
connecting to the extension provided the total of such reimbursement shall not
exceed the cost incurred by the applicant to construct the extension, and plans to
reimburse applicant for construction of sewer extension shall require the~proval
of the County Council by resolution.
The 1" WHEREAS has been changed which reads:
WHEREAS, APPLICANTS Tante and Araceli Urban have [requested submitted
an application to extend the sewer along Kalawa Street in accordance with Section 21-26,
Hawaii County Code, said application and construction plans being attached hereto as
Attachment "A"; and
The 4'~ WHF;REAS has been changed which reads:
WHEREAS, applicants'fante and Araceli Urban have proposed to [comply
construct the extension in accordance with Section 21-28(a), Hawaii County code
regarding payment of costs; and
The 5'~ WHEREAS which reads:
WHEREAS, The Director of the Department of Environmental Management has
recommended approval of the extension; and
The NOW. THEREFORE, BE I'f RESOLVED BY THE COUNCIL OF THE COIJN"fY
OF HAWAII has been changed which reads:
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE.
COUNTY OF HAWAII that the sewer extension [to] along Kalawa Street [for] by
Tante and Araceli Urban is hereby approved.
One BE IT FUR'T'HER RESOLVED, were added to the body of the resolution.
The 1" BE 1T FURTHER RESOLVED which reads:
BE IT FURTHF,R RESOLVED that the request of Tante and Araceli Urban to
be reimbursed for the cost of the sewer extension alone Kalawa Street in accordance with
section 21-28 (a) of the Hawaii County Code is hereby annroved.
