RESOLUTION NO. 80 03

RESOLUTION AUTHORIZING THE 1) EXTENSION OF THE PUBLIC SEWER ALONG
KALAWA STREET; AND 2) REIMBURSEMENT FOR THE COST OF CONSTRUCTION OF
THE EXTENSION FOR TANTE AND ARACELI URBAN, AT KAILUA-KONA, HAWAI`1
WHEREAS, applicants Tante and Araceli Urban have submitted an application to extend the sewer along
Kalawa Street in accordance with Section 21='6, Hawaii County Code, with said application and construction
plans being attached hereto as Attachment "A"; and
WHERF,AS, sewer extensions are beneficial to the community by eliminating existing cesspools and
reducing the amount of pollutants reaching the groundwater and the coastal waters, resulting in a cleaner, healthier
environment; and
WHEREAS, Section Z 1-26. Hawaii County Code, requires that all sewer extensions shall be approved by
resolution of the County Council; and
WHEREAS, applicants Tante and Araceli Urban have proposed to construct the extension in accordance
with Section 21-28(a) Hawaii County Code, regarding payment of costs; and
WHEREAS, the Director of the Department of Environmental Management has recommended approval of
the extension; and
WHEREAS, in accordance with Section 21-28(a), Hawaii County Code, the applicant may receive for ten
years after completion of the extension one-half of all moneys for sewer charges collected by the County from other
properties connecting to the extension, provided the total of such reimbursement shall not exceed the cost incurred by
the applicant to construct Che extension, and plans to reimburse applicant for construction of sewer extensions shall
require the approval of the County Council by resolution.
NOW, TIiEREFORE, i~E IT RESOI,VF,D BY TFIE COUNCIL OF TH1=. COUNTY OF iiA`YAI'I that the
se~ser extension along Kalawa Strc`t by T ante and Araceli Urban is hereby approved.
BE IT FURTHER RESOI.VF.D that the request of Tante and Araceli Urhan to be reimbursed for the cost of
the sewer extension along Kala~:~a Strec in accordance with Section 21-28(a), iiaE~~ai`i County Code, is hereby
approved.
BE IT FURTHER RESOL.VF,D that the Clerk of the County of I-lawai'i transmits copies of this resolution
to the D~partmcnts of Finance, Public `.Yorks and Environmental Management.

Dear Barbara:
Pursuant to the Hawaii County Code, Division 4 "Extension", Section 2L-26
"Application for extensions". We are requesting construction of a sewer extension from the
south end of Kalawa Street approximately 110 feetlong to the north. We are currently, planning
improvements to our property for a three story, seven unit apartment building.
We wish to comply with section 21-28 (a), whereas we will construct the sewer extension for
the County and in return, receive stated benefits from the County for the stated period of time.
