Registered letters sent to remaining Councilmembers providing notitication of vacancy. Press release issued by Council Chair informing the public of the vacancy. August 2Q 2003 Nomination and Voting Procedure approved. August 26, 2003 Deadline for applicants to submit letters of interest. Applicants will also be asked to complete an optional informational form which will be released to the media. (State law limits the type of personal information the Council can disclose about the applicants. However, applicants may choose to disclose the information.) Qualified applicants shall have their names placed on the September 4 agenda. The Elections Division will verify eligibility before the Council's September 4 agenda is finalized and posted on August 28. September 4, 2003 The matter of the selection will be taken up under "Other Business." The Chair will ask for a motion to consider all ucLahfied applicants. All qualified applicants will be provided with five minutes each to make statements. Members of the public who have not yet had the opportunity to speak will be provided with three minutes to testify. (Members of the public who wish to testify at the beginning of the meeting during "Statements from the Public on Items on the Agenda," will be asked if they would prefer to speak later when the matter is taken up.) After public testimony and Council discussion, voting will be conducted as follows. The roll will be taken and each Councilmember will be asked his selection (each Councilmember voting for just one applicant). In this way, no member has to vote "No" on any applicant. An applicant receiving five or more votes will he deemed selected. If no applicant receives five or more votes, the names of the two (or more, if tie votes) applicants receiving the most votes shall have their names placed on the agenda of the September 17, 2003 Council meeting for further consideration. Curtis Tyler Hawaii County Council 77-6399 Nalani Street, #;104 Kailua-Kona, Hawaii 96740 RE: Council Vacancy Dear Colleague: ' 1'he purpose of this letter is to notify you, pursuant to Section 3-4, Article III of the Hawaii County Charter, that at the beginning of our regularly scheduled meeting of August 20, 2003, formal action will be taken to fill the vacancy on the County Council created this morning by the resignation of Councilmember Bobby Jean Leithead-Todd. Because the vacancy did not become effective until this morning, the August 20 meeting is the first at which we could properly place the matter on the agenda, pursuant to the "Sunshine Law" (the deadline for posting the agenda of the August 6, 2003 meeting was yesterday). In 1996, the last lime vacancies occurred on the Council, a selection process was developed and announced by the Chair. After meeting with Lincoln S. T. Ashida, our Corporation Counsel, I believe that the process we employ should be established by the Council. Enclosed with this letter is a proposed Nomination and Voting Procedure that Honorable Councilmembers RE: Council Vacancy August 1, 2003 Page two the County Clerk developed, which was based closely on the process and procedure used in 1996 (also enclosed) and which will be placed before you on August 20 under the topic heading, "Other Business." One notable change is that I suggest that all qualified applicants have their names placed in nomination. I believe that any person who offers himself or herself for public service should be officially considered by the Council. If the process is adopted on August 20, the actual selection would occur at our regularly scheduled meeting of September 4. [f the Council can not reach a decision at that meeting, the matter would be taken up again on September 17. I look forward to a smooth transition. Please contact me if you have any questions.
