Subject: Access Easemeat Request,- Keaau Service Statiaa, Ync.

Keaau Service Station, inc. (hereinafter KSSI) operates a service station on the
subject property. The subject site, consisting of .466 acres, is leased by KSSI from the
State of Ilawaii (General Lease No. 5-5015) to May l8, 2022.
KSSI also owns an adjoining property consisting of 7.844-acres and identified by
TMK: (3) 1-7-01:011. 'That property is zoned Agriculture (A-Sa) by the County. KSSI
is in the process of having a 2.814-acre portion of this area rezoned into the commercial
district (CV-20) to allow the continued use of its vehicular towing business associated
with the service station. The Planning Director and Planning Commission have favorably
recommended the approval of this rezoning to fhe County Council. The Council is
anticipated to act on the request by October of this year.
In the interest of safety and improved traffic circulation in this area, KSSI is
requesting an access easement through the State-owned service station site to service the
2.814-acre area.
Proiect Location
The subject property, consisting of .466 acres and identified by TMK: (3) 1-7-01:
063, is located adjacent to and southwest of the Iiawai'i Bak Road (highway 11). It is
the site of the Keaau Service Station and identified as such on the attached map
(Fignre 1). Please note, however, that the location of the property to be serviced by the
requested access easement is identified as the "Subject Site" in Figure 1. The exact
location and configuration of the State land (service station site) and the site to be
serviced (TMK: 1-7-01: Ol 1) is found in Figure 2.

Proicct Description
As noted above, KSSI has filed an application w rezone a 2.814-acre area
abutting the State-owned service station site to allow the continued use of a vehicular
towing business associated with the service station. After receiving favorable
recommendations from the Planning Director and Plarming Commssion, this matter is
now before the County Council. Final Council action is anticipated to occur by October.
The State Department of Transportation -Highway Division is in the process of
znaldng improvements to the Huina Road/Belt Highway intersection. The improvements
call for dedicated left rum lanes from the Highway to Huina Road and the service station.
This will, however, necessitate the relocation of the existing service station access about
50 feet to the southwest (or volcano side). Access to the 2.814-acre area would also be
available less than. 75 feet fxom the planned service station access. A sketch of the
planned improvements is found in Figure 3. While traffic lights are desired, funding for
that portion of the improvements is not available. The planned improvements are
scheduled to begin this year and be completed by summer of 2004.
In preparing the rezonittg application relating to the 2.814-acre area and
subsequent to the submittal of this request, this office had discussions with i41r. Robert
Taira of the Hawai i District office of the Department of Tratuportation -Highways
Division. Mr. Taira indicated that his office preliminarily would prefer access to the
2.914-acre area be from the State-owned service station site rather than the permitted
access 75 feet away. Further, inasmuch as funding is not available for the much-needed
traffic lights, having KSSI participate in its construction as a condition of having this
access would be ideal.
Please be informed that KSSI is committed to paying up to 50% of the cost of the
traffic lights if access were allowed through the State-owned service station site. Please
note that the Plaiuaing Dirxtor and Planting Commission have also recommended
favorably on the rezoning to the County Council with that condition. The condition read:
"Access from the project site to State Highway 11 shall meet with the approval of
the ]7eparhnent of Transportation. The applicant shall secure an agreement from
the State to use the relocated service station easement. tfpermisston is obtained,
occess shall be solely from that easement. Should the State gram an easement
through the existing service station property, the applicant shall pay 50% of the
cost of insialladan of a traffic signal at the intersection of Huina Road and
Highway l] to conjunction with the State's planned intersection improvements."
As noted in the attached letter, dated July 31, 2003, firm the Planning Director to the
State DOT, the developer on the opposite end of Huina Road is committed to providing

the other 50% of the cost of the lights. As such, the traffic lights could be developed in
conjunction with the other roadway improvements later this year using private funds.
Request
In view of the foregoing, KSSI hereby requests a minimum 60-foot wide access
easement from Highway 11 through the state-owned property identified by TMK: (3) 1-
7-01:063 in the general location reflected on Figure 3.
It is my understanding and hope that this request, pursuant to Chapter 343, HRS,
could be considtted an "exempt" action by your office. The requested access will be in a
location already sanctioned by the State DOT as an access. Furthermore, all of the
improvements within the proposed easement area have been fu11y improved. In that
evem, an "exempt" action may be appropriate, obviating the need for the preparation of
an Environmental Assessment or Environmental Tmpact Statement
