SUBJECT: BALLARD MORTUARY -REQUEST FOR GRANT OF EASEMENT

We have reviewed your request and instead of an easement, we are recommending and will support the
fee disposal of a portion of Alenaio Street to resolve your encroachment problem. Attached is a sketch
showing the area to be abandoned and disposed.
Granting of an easement will not relieve the County of all liabilities associated with the encroachment
as we would still be the fee owners of the property. Our proposal would address our liability concerns
and will correct your client's encroachment problem.
Because the Public Works Director does not have the authority to dispose the property, by a copy of this
letter we have forwarded your request to the Finance Director. However, we are willing to provide
technical assistance in preparing (naps, submitting an abandonment resolution and processing a
subdivision application to establish a remnant parcel.
