DEVELOP AROADS-IN-LIM[30 POLICY.
Whereas, Chapter 264, F[awai`i Revised Stahites, divides govenuneut highways into two
types: (1) the state highway system and (2) county highways, and
Whereas, there arc numerous roads that do not currently fall under either system of
roadways; and
Whereas, these roads have been traditionally identified as "roads-in-limbo~~: and
Whereas, the Public Works Deparuncnt estimates that there are over 450 miles of such
"roads-in-limbo" on the Island of Hawai' i; and
Whc reas, ownership. maintenance responsibility and legal access have been long-
standing issues related to "roads-in-limbo' ;and
Whereas, the Public Works Department presently addresses "roads-in-limbo" on a case-
by-case basis and as funds permit.
NOW, "I~HEREFORI?, I31? I'f RESOLVED BY THE COUNCIL OF TIIE COUNTY OF
I [AWAIT that it recognizes the need to de~-elop a comprehensive "roads-in-limbo" policy for the
Island of I iawai'i.

the Planning Department, the Ofl ice of the Corporation Cowisel and the Legislative Auditor's
Office all assign representat'ive(s) to serve on amulti-agency task force charged with developing
a draft roads-in-limbo polio .
I3I? IT PUR'fI IER RESOLVED that the Department of Public Works is requested to
serve as the Icad agency throughout this project.
BE IT FURTHER RESOLVED that the multi-agency task force is requested to submit to
the Council a task force work plan no later than sixty days after the adoption of this resolution.
BE IT FURTHER RESOLVED that the multi-agency task force shall formulate a draft
roads-in-limbo policy that includes, at the least, the following:
1. Inventory and road identification procedures
2. Prioritization standards for improvement and/or maintenance of roads-in-limbo
3. Improvement and maintenance options
4. Funding alternatives and resources
5. Legislation needed to implement the policy
6. Implementation Road Map
BE IT FUTHER RESOLVED that the Council requests the proposed "roads-in-limbo" policy
be forwarded to the Council by August 2004.
BE IT FURTHER RESOLVED that the Clerk of the County of Hawaii is hereby instructed to
transmit copies of this resolution to Department of Public Works, the Planning Department, the Office
of the Corporation Counsel and the Office of the Legislative Auditor, upon approval.
