RE: Attached 13111 No. 98, Draft 2 Relating To Real Property Disposition
In February 2000, we released a report entitled Special Study On Cn~ln(y Of Hawaii /.eu.t~ea {1'Nh
Nonprufrt Organiza/ions. On May 3, 2000 the Hawaii County Council approved and adopted Report No.
6 from the Committee On Humans Services and Economic Development that outlined amendments to
Chapter 2 of the Hawaii County Code as suggested in the special study. These amendments
recommended amendments were as follows:
I . Establish the Finance Department as the central repository for all real property
instruments and document,.
2. Require an annual tenancy report to the Council.
3. Included minimum conditions of real properly agreements.
4. Place the Council at the end of the negotiation process.
'These proposed amendments were introduced in Bill No. 98. The Council's Finance Committee first
considered this measure in September 2001. At this meeting, the Finance Canmittee voted to deter Bill
No. 98 so that additional lease clauses could he incorporated.
Bill No. 9f3, Draft which is attached, reflects the supplementary amendments suggested by the Finance
Committee. Specifically, the following items have been included in this latest draft:
I . Section 2, revised to read, "Minimum Provisions and Clause."'.
Provisions # 1.2,3,7, 8!>.12,13. 1~3, and U added.
Please have Bill No. 98, Drafl 2 and the attached supporting documents referred to the Finance
Committee for further consideration.
