RESOLUTION NO. 119 03
RESOLUTION AUTHORIZING THE ABANDONMENT, EXCHANGE, AND SALE OF A PORTION OF
THE OLD PAHOA-KALAPANA ROAD TO LORAN LEE (PORTION OF TAX MAP KEY:(3)1-3-001).
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII:
WHEREAS, the old Pahoa-Kalapana Road was partially abandoned by the State of Hawaii
upon the completion of the new Pahoa-Kalapana Road; and
WHEREAS, the actual right-of-way for the old Pahoa-Kalapana Road is split along the property
line between Tax Map Keys:(3)1-3-001-019 and 1-3-001-047, which lines the right-of-way physically
separated (see Exhibit "A"); and
WHEREAS, Loran Lee, who owns the majority of the adjacent property, has offered the
exchange of a portion of his property to create aright-of-way between the two unconnected portions
of the old Pahoa-Kalapana Road (see Exhibit "A"); and
WHEREAS, Loran Lee is willing to purchase other portions of the old Pahoa-Kalapana Road
which adjoins his property (see Exhibit "A"); and
WHEREAS, no other adjacent property owner has objected to this abandonment and transfer
of that portion of the roadway to Loran Lee; and
WHEREAS, all roadways, once established, continue until vacated, closed, abandoned or
discontinued by resolution of the Council; and
WHEREAS, the right-of-way in question has not been maintained by the County and in fact,
does not adjoin any through streets and has not served as a vehicular transportation corridor; and
WHEREAS, the County of Hawaii finds that the subject right-of-way is economically and
physically unsuitable or undesirable for development or utilization as a separate unit by reason of its
location, size and shape, and by definition is a remnant in accordance with Section 2-110, Definitions,
Hawaii County Code; and
WHEREAS, Section 2-111, Hawaii County Code, permits the exchange of real property for
private property, and Section 2-118, Hawaii County Code, allows for the disposal of remnant parcels;
and
WHEREAS, the exchange of real property, while not equal in size, is advantageous to the
County of Hawaii in that it will provide aright-of-way between the two unconnected portions of the old
Pahoa-Kalapana Road; and
WHEREAS, Loran Lee shall purchase the remainder of the roadway not exchanged with the
County of Hawaii; and
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII,
that the portion of the old Pahoa-Kalapana Road as delineated on Exhibit "A" is hereby declared
abandoned and otherwise discontinued as a right-of-way, that it is physically and economically
unsuitable or undesirable for development or utilization as a separate unit by reason of its location,
size and shape, and is hereby declared a remnant as set forth in Section 2-110, Hawaii County
Code, and pursuant to Sections 2-115 and 2-118, authorizes the disposal by exchange and sale of
road remnant, Tax Map Key:(3) 1-3-001.
BE IT FURTHER RESOLVED that the County Clerk shall transmit a copy of this resolution to
(1) the Honorable Harry Kim, Mayor of the County of Hawai`I; (2) William Takaba, Director of Finance;
(3) Bruce McClure, Director of Public Works; and (4) Loran Lee, 13-3775 Kalapana Highway, Pahoa,
Hawaii 96778.
