AN ORDINANCE AMENDING CHAPTER 19, OF THE HAWAII COUNTY CODE 1983 (1995 EDITION), RELATING TO REAL PROPERTY TAXES, BY REALIGNING WATER TANK EXEMPTIONS. BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: SECTION 1. The purpose of this measure is to clarify section 19-54, water tank exemption, by removing it from article 7, tax map; valuations, and placing it in article 10, exemptions. SECTION 2. Chapter 19, article 7, section 19-53, of the Hawaii County Code 1983 (1995 edition), is repealed. [Section 19-54. Water tanks. Any provision to the contrary notwithstanding, any tank or other storage receptacle required by any govemment agency to be constructed or installed on any taxable real property before water for home and farm use is supplied, and any other water tank, owned and used by a real property taxpayer for storing water solely for his or her own domestic use, shall be exempted in determining and assessing the value of such taxable real property.] SECTION 3. Chapter 19, article 10, section 19-81, of the Hawaii County Code 1983 (1995 edition), is amended to read as follows: Section 19-81. [Reserved] Water tanks. SECTION 4. Material to be repealed is bracketed. New material is underscored. In printing this ordinance, the brackets, bracketed material and underscoring need not be included. SECTION 5. If any provision of this ordinance, or the application thereof to any person or circumstance, is held invalid, such invalidity shall not affect other provisions or applications of the ordinance which can be given effect without the invalid provision or application, and to this end, the provisions of this ordinance are declared to be severable. SECTION 6. This ordinance shall take effect upon its approval.
