RESOLUTION NO. 120 03
RESOLUTION AUTHORIZING THE GRANT OF EASEMENT FOR UNDERGROUND FIBER OPTIC
CONDUITS WITHIN THE COUNTY OF HAWAII RIGHTS-OF-WAY.
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII:
WHEREAS, Sandwich Isles Communication, Inc. received a Public Utilities Commission
Certificate of Authority and has undertaken a project to provide Department of Hawaiian Home Lands
properties with modern high-speed fiber optic cable service through private funding and the
U.S. Department of Agriculture's rural utility service program; and
WHEREAS, the Council of the County of Hawaii had previously adopted Resolution No. 98-01
supporting the State Department of Hawaiian Home Lands telecommunication infrastructure and
service project, and recognized the economic, social and financial benefits of the Sandwich Isles
Communication, Inc.'s telecommunication network to the County of Hawaii; and
WHEREAS, parts of the network must be located within County of Hawaii rights-of-way and
other County lands; and
WHEREAS, public utilities are allowed to locate within County of Hawaii rights-of-way
pursuant to Section 22-3.2, Hawaii County Code; and
WHEREAS, Sandwich Isles Communication, Inc. seeks authorization to locate its lines within
County of Hawaii rights-of-way and other properties; and
WHEREAS, pursuant to Section 2-111(a)(2), Hawaii County Code, the Council is authorized
to grant easements for particular purposes, subject to reverter to the County of Hawaii upon
termination or abandonment of the specific purpose.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII,
that the Finance Director is hereby authorized to grant easements to Sandwich Isles Communication,
Inc., pursuant to Chapter 2, Article 19, Hawaii County Code, within County of Hawaii rights-of-way
and properties as needed to complete its fiber optic network, and that such grants of easements are
subject to reversion to the County of Hawaii upon its termination or abandonment.
BE IT FURTHER RESOLVED that the County Clerk shall transmit a copy of this resolution to
(1) Sandwich Isles Communication, Inc., Pauahi Tower, 27th Floor, 1001 Bishop Street, Honolulu,
Hawaii 96813; (2) William Takaba, Director of Finance; (3) Bruce McClure, Director of Public Works;
and (4) Assistant Corporation Counsel Gerald Takase.
