Topic: Legislative Proposals for 2004 State Legislature
Aloha Colleagues,
I have a number of suggestions for state legislation. These are as follows:
1) Full funding for an Advanced Cardiac Life Support (ACES) ambulance service for the
Oceanview Community; the lengthy response time for this community is unacceptable
and results in a serious liability situation for both the county and the state; no other
area with this population in the state has such a lengthy response time for ambulance
service;
2) A state funded water well for the Oceanview Community (this is overdue and properly
a state function);
Legislation is needed to mandate the compilation and registry of locations of
unexploded ordnance (UXO), and other toxic substances released by the military on
all lands, and submerged lands of this state. In order to utilize good planning
procedures, the state and counties need to know the location of sites where live
unexploded ordnance has been found, where live ordnance was dumped, where UXO
is thought to exist or where live fire training of the military has occurred, and where
toxic agents have been released as part of military exercises. Investors and
homebuyers need a reliable source of information to know if the lands they are buying
are suitable for human use or may present serious threats to life and limb. Currently
realtors of this state say they have no information available to them and do not inform
clients of this potential problem due to a lack of information available to them.(~(

4) Legislation to curb dumping of garbage and waste products into Hawaiian waters by
cruise ships. Cruise companies found guilty of state or federal rules would not be
allowed to enter Hawaiian ports or waters, and would not qualify for any state
subsidies advertising programs or tax incentives.
5) End the automotive safety inspection program, it is a waste of $15m year for Hawaii
motorists and doesn't improve driver or pedestrian safety at all.
,6) Oppose changes to current land use law.
/ 7) Funding to acquire coastal lands through TAT, CIP funds, and conveyance taxes.
/8) TAT should apply to cruise ships as well as hotels as it does now.
9) Enhanced penalties for letting mud from construction sites enter coastal waters from
construction sites or other sources.
10) Legislation to prevent the unregulated release or unwanted release of genetically
modified organisms (GMO) pollens, drugs, or seed strains. Legislation to hold
companies doing GMO research responsible for the release of these organisms and to
make individuals whole if they suffered economic loss for the release.
11) Legislation mandating that anything over 160 years (predating the Great Mahele) such
as public works like fishponds, temples, graves, heiaus, roads, trails, and other public
features should be held by the state government in trust for perpetuity.
12) Clean elections proposals that promote open government and prevent the undue
influence by companies doing business in Hawaii on government.
13) Prevent gambling from becoming legal in this state.
14) A statewide ban on smoking in all public places such as parks, beaches, all
government buildings, restaurants, bars, public conveyances and other related areas.
15) Legislation enabling Hawaiians to restore fishponds without burdensome regulations.
Currently it only requires a grubbing permit at to destroy a fishpond and several
thousand pages of regulations to follow to restore a fishpond.
